Overview

The South Australia Class 3 23m Long Single Deck Vehicle Carrier Exemption Notice 2023 (No.1) was enacted to address the need for flexibility in the transportation of vehicles in South Australia, specifically for class 3 heavy vehicles that are vehicle carriers with a single deck and that are no more than 23 meters in length. This exemption notice, made under the Heavy Vehicle National Law (HVNL), grants exemptions from certain dimension requirements for eligible vehicles, providing regulatory relief while ensuring road safety and compliance with specific conditions. The notice revokes the South Australia Class 3 23m Long Single Deck Vehicle Carrier Exemption Notice 2020 (No.1) and aims to streamline operations for vehicle carriers that meet the specified criteria. The exemption notice is set to commence on 27 October 2023 and will expire on 26 October 2028, providing a five-year period during which the exemptions and conditions apply.

Scope and Application

This exemption notice pertains to the South Australia Class 3 23m Long Single Deck Vehicle Carrier Exemption Notice 2023 (No. 1), which provides exemptions from certain dimension requirements for class 3 heavy vehicles that are vehicle carriers with a single deck and are no more than 23m in length. These vehicles must be loaded exclusively with vehicles or be unladen to qualify for the exemption. This notice applies specifically within South Australia and is effective from 27 October 2023 until 26 October 2028. An eligible vehicle, which is one that meets the specified conditions, is exempt from certain dimension requirements such as length and rear overhang, provided it adheres to the conditional dimension limits outlined in the notice. Furthermore, the notice mandates that eligible vehicles must not exceed 23.0m in length, and must be capable of being reduced to 19.0m when unladen. Additionally, no load must be carried above the cabin of the rigid truck. The notice also specifies certain areas and routes where these vehicles can operate, subject to compliance with road, travel, and vehicle conditions as per the Heavy Vehicle National Law. This notice revokes the South Australia Class 3 23m Long Single Deck Vehicle Carrier Exemption Notice 2020 (No.1).

Key Provisions

The South Australia Class 3 23m Long Single Deck Vehicle Carrier Exemption Notice 2023 (No.1) outlines specific exemptions from dimension requirements for class 3 heavy vehicles that are vehicle carriers, with a single deck and a maximum length of 23m. This notice (sections 1 and 7) applies to vehicles that are either loaded exclusively with vehicles or unladen, and it is limited to South Australia. An eligible vehicle is one that meets the conditions of this notice. It exempts these vehicles from certain dimension requirements (section 8) but only to the extent that the conditional dimension limits in sections 9 and 10 are met. The notice also mandates that when multiple dimension limits apply, the stricter limit must be adhered to. The notice imposes several conditions on eligible vehicles. Firstly, the vehicle must not exceed 23.0m in length (section 9). Secondly, the rear overhang of the trailer must not exceed 4.9m, provided any overhang greater than 3.7m consists only of a vehicle that is not a heavy vehicle (section 10). Additionally, the vehicle must be capable of being reduced to 19.0m in length when unladen (section 11). Lastly, no load can be carried above the cabin of the rigid truck (section 12). Vehicles complying with these conditions are authorised to operate on specific routes and areas detailed in the notice (section 13). When operating, these vehicles must comply with road conditions, travel conditions, and vehicle conditions as specified in the Heavy Vehicle National Law. Breaches of the conditions outlined in the notice can lead to civil and criminal consequences. Although the notice does not explicitly state the penalties, penalties for breaches of the Heavy Vehicle National Law generally include fines and potential imprisonment. For example, under section 281 of the Heavy Vehicle National Act, an individual can be fined up to $12,150 and/or face imprisonment for up to 12 months for non-compliance with vehicle dimension requirements. Additionally, corporations can face fines up to $60,750. The exact penalties would depend on the nature and severity of the breach, as well as any relevant jurisdictional laws.
