Overview

The South Australia Class 1 Utility Pole Transportation Dimension Exemption Notice 2023 (No. 1) was enacted to provide exemptions from dimension requirements for class 1 heavy vehicles transporting utility poles for installation or maintenance activities. This notice was made under section 117 of the Heavy Vehicle National Law, allowing the Regulator to exempt specific categories of vehicles from compliance with mass or dimension requirements. It also revokes the South Australia Class 1 Stobie Pole Transportation Dimension Exemption Notice 2019 (No. 1). The notice applies to prime mover and semitrailer combinations carrying utility poles not exceeding 26.0 meters in length, operated by SA Power Networks or a contracted entity for utility pole installation or maintenance in South Australia. It provides exemptions from certain dimension requirements and specifies alternative compliance requirements for warning devices, dimension limits, escort requirements, and stated areas or routes. The notice aims to facilitate the efficient transportation of utility poles while ensuring safety and compliance with regulatory standards. The notice is authorised by the National Heavy Vehicle Regulator and is intended to streamline the transportation of utility poles for installation or maintenance purposes, while still maintaining necessary safety standards. By providing specific exemptions and conditions, the notice seeks to balance operational efficiency with public safety and compliance with regulatory requirements. The exemption notice comes into effect on 3 November 2023 and will expire on 2 November 2028, unless otherwise amended or repealed.

Scope and Application

The South Australia Class 1 Utility Pole Transportation Dimension Exemption Notice 2023 (No.1) provides specific exemptions from certain dimension requirements for class 1 heavy vehicles transporting utility poles for installation or maintenance purposes in South Australia. This exemption applies to prime mover and semitrailer combinations carrying utility poles not exceeding 26.0m in length, provided they are operated by SA Power Networks or an entity contracted to SA Power Networks. The exemption is limited to vehicles used for utility pole installation or maintenance and only applies within the jurisdictional boundaries of South Australia. Vehicles that meet the specified criteria and adhere to the conditions outlined in the notice are considered eligible and can operate under this exemption. The notice exempts eligible vehicles from certain dimension requirements specified in the Heavy Vehicle (Mass Dimension and Loading) National Regulation but imposes specific dimensional limits, alternative compliance requirements for warning devices, escort requirements, and conditions for stated areas or routes. This notice revokes the South Australia Class 1 Stobie Pole Transportation Dimension Exemption Notice 2019 (No.1) and commences on 3 November 2023, expiring on 2 November 2028. The notice is made under the Heavy Vehicle National Law, specifically section 117 which pertains to the Regulator’s power to exempt certain heavy vehicles from mass or dimension requirements, and section 23 of Schedule 1 which allows for the amendment or repeal of instruments. The notice also incorporates certain information from the South Australia Class 1 Utility Pole Transportation Operator’s Guide, published by the National Heavy Vehicle Regulator, which operates in conjunction with this notice. The exemption aims to facilitate the transportation of utility poles for installation or maintenance activities while ensuring compliance with other specified conditions to maintain road safety and operational standards.

Key Provisions

The key sections of the South Australia Class 1 Utility Pole Transportation Dimension Exemption Notice 2023 (No.1) detail the exemptions and conditions that apply to class 1 heavy vehicles transporting utility poles in South Australia. Section 7 defines the scope of the exemption, applying to prime mover and semitrailer combinations carrying utility poles up to 26.0m in length operated by SA Power Networks or their contractors, used for installation or maintenance activities (section 7(2)). This notice applies specifically in South Australia and commences on 3 November 2023, expiring on 2 November 2028 (sections 4 and 5). Section 8 outlines the exemption from certain dimension requirements, specifically those related to the length of the vehicle and rear overhang, provided the vehicle adheres to the conditions stipulated in section 9 (section 8(1)). These conditions include maximum dimensions for the vehicle length and rear overhang, which must not exceed 33.0m and 25% of the vehicle length respectively (section 9). The obligations imposed by the notice require compliance with several conditions to maintain the exemption. Eligible vehicles must adhere to maximum dimension limits specified in section 9 and follow alternative compliance requirements for warning devices as outlined in section 10. These requirements include specific delineations on utility poles and the use of reflective stripes, warning lights, and signs (section 10(4)). Furthermore, vehicles must comply with escort requirements, including the need for a rear pilot if the rear overhang exceeds 5.5m (section 11(2)). Additionally, vehicles must adhere to any restrictions or conditions specified in the Guide regarding stated areas or routes, ensuring compliance with road, travel, and vehicle conditions as per sections 160, 161, and 162 of the Heavy Vehicle National Law (HVNL) (section 12). Failure to comply with the conditions and requirements set forth in this notice may result in various consequences. While the notice does not explicitly detail specific penalties, non-compliance with the Heavy Vehicle National Law or its regulations could lead to enforcement actions. For instance, section 136 of the HVNL allows for the imposition of penalties for breaches, which could include fines or other legal repercussions. Additionally, operating a vehicle that does not meet the safety and compliance standards could potentially lead to civil liabilities or criminal charges under relevant road safety and transport legislation. The exact penalties would depend on the nature and severity of the breach, but they could include substantial fines or other legal consequences as determined by the courts.
