Overview

The South Australia Class 1 Opal Mining Vehicle Dimension Exemption Notice 2023 (No.1), issued under the Heavy Vehicle National Law, provides exemptions for certain special purpose vehicles used in opal mining from specific dimension and vehicle standards requirements. This exemption Notice, which replaces the previous 2019 version, was introduced to streamline regulatory compliance for vehicles integral to opal mining activities, such as blowers, noodling machines, elevators, and prospecting drills, while ensuring safety and operational efficiency within the mining sector. Authorised by sections 61, 117, and 23 of Schedule 1 of the Heavy Vehicle National Law, the Notice aims to facilitate the unique operational needs of opal mining vehicles in South Australia. This exemption Notice commences on 28 July 2023 and will remain in effect until 27 July 2028, providing a clear framework for the temporary relaxation of certain regulatory burdens for these specialised vehicles.

Scope and Application

The South Australia Class 1 Opal Mining Vehicle Dimension Exemption Notice 2023 (No.1) applies specifically to Class 1 special purpose vehicles used in opal mining within South Australia. These vehicles, which include blowers, noodling machines, elevators, and prospecting drills, are granted certain exemptions from compliance with vehicle dimension and standards requirements as stipulated under the Heavy Vehicle National Law. This exemption Notice replaces the previous 2019 version and is effective from 28 July 2023, expiring on 27 July 2028. Vehicles eligible under this Notice must adhere to specific conditions, including a width limit of 4.0 metres, and are permitted to operate only during daylight hours on designated roads within specified radii of Coober Pedy, Marla, and Andamooka, with compliance to height clearances and other travel conditions as prescribed by relevant South Australian authorities. This Notice, under the authority of the Heavy Vehicle National Law, aims to facilitate the operation of specialised mining vehicles within regulated parameters while ensuring safety and compliance with broader vehicle standards outside the scope of this exemption.

Key Provisions

The South Australia Class 1 Opal Mining Vehicle Dimension Exemption Notice 2023 (No.1) provides specific exemptions from dimension and vehicle standards requirements for certain special purpose vehicles used in opal mining. This Notice (sections 1-12) applies to Class 1 vehicles such as blowers, noodling machines, elevators, and prospecting drills used for opal mining within specified areas in South Australia. The Notice exempts these vehicles from certain vehicle standards (section 8) and dimension requirements (section 9), such as those relating to width, height, and various vehicle standards like turning ability, protrusions, and lights and reflectors. However, these exemptions come with conditions, such as a maximum width of 4.0 metres (section 10) and restrictions on operation to daylight hours only (section 11). Additionally, these vehicles must adhere to specific route conditions and height clearances as prescribed by the South Australia Department of Infrastructure and Transport (sections 11 and 12). Under this Notice, eligible vehicles must comply with certain operational conditions to ensure safety and compliance with broader regulatory requirements. For instance, they must not exceed a width of 4.0 metres (section 10) and must only be operated during daylight hours, with restrictions on use during low visibility and wet conditions (section 11). Moreover, these vehicles must adhere to height restrictions as indicated by the Height Clearances on and Under Structures map (section 12). Operators of these vehicles must also comply with road, travel, and vehicle conditions stipulated under the Heavy Vehicle National Law (HVNL) (section 12). Breach of the conditions set forth in the Notice may result in legal consequences. Although specific penalties are not detailed within the Notice, violations of the HVNL or its regulations can lead to significant fines and other penalties as prescribed by relevant laws. For example, contravening the vehicle standards or dimension requirements could lead to enforcement actions, fines, or even criminal charges depending on the severity and intent of the breach. Operators must ensure full compliance with all conditions to avoid any legal repercussions.
