Overview

The South Australia Class 1 Load Carrying Vehicle Dimension Exemption Trial Notice 2025 (No.1), enacted under section 117 of the Heavy Vehicle National Law, aims to provide exemptions from certain dimension requirements for class 1 heavy vehicles transporting large indivisible items that comply with specified mass limits. This trial notice, made by the National Heavy Vehicle Regulator, aims to facilitate the transport of oversized loads within defined parameters in South Australia from 23 January 2025 until 22 January 2030. Eligible vehicles, including rigid trucks, trucks towing a trailer, prime movers towing semitrailers, and prime movers towing extendable semitrailers, are subject to specific dimensional and operational conditions to ensure safety and compliance with road regulations. Drivers must carry a copy of this notice and produce it upon request by authorised officers or police officers, ensuring transparency and adherence to the established guidelines.

Scope and Application

The South Australia Class 1 Load Carrying Vehicle Dimension Exemption Trial Notice 2025 (No.1) is a regulatory instrument designed to provide temporary exemptions from certain dimension requirements for specific class 1 heavy vehicles transporting large indivisible items, provided they do not exceed prescribed mass limits. This notice applies to class 1 heavy combinations in South Australia, including rigid trucks, rigid trucks towing one trailer, prime movers towing semitrailers, and prime movers towing extendable semitrailers, provided they are fitted with a single steer axle and a dual-drive tandem axle group. The exemption applies solely to vehicles designed or used to transport large indivisible items. The notice exempts eligible vehicles from certain dimension requirements such as length, width, height, and rear overhang, but only to the extent that specific conditional dimension limits are adhered to as outlined in the notice. These conditions include restrictions on width, length, height based on the type of vehicle, and rear overhang, which vary depending on the length of the vehicle combination. Additionally, there are specific requirements for deck height when the load exceeds 4.8m, and conditions regarding the carriage of a notice, pilots, and escorts, as well as compliance with road, travel, and vehicle conditions. The notice will be in effect from 23 January 2025 until 22 January 2030, during which time eligible vehicles must comply with all conditions to maintain their exemption status.

Key Provisions

The South Australia Class 1 Load Carrying Vehicle Dimension Exemption Trial Notice 2025 (No.1) (the Notice) is a legal instrument issued under the Heavy Vehicle National Law (HVNL) that provides temporary exemptions from certain dimension requirements for class 1 heavy vehicles that are transporting large indivisible items, provided they meet the prescribed mass requirements. This Notice applies to class 1 heavy combinations that are rigid trucks, rigid trucks towing one trailer, prime movers towing a semitrailer, or prime movers towing an extendable semitrailer. The Notice allows these vehicles to carry or be designed for carrying large indivisible items, provided they do not exceed specific dimensional limits, and operate within designated areas in South Australia. The Notice imposes several conditions on the operation of eligible vehicles. These include adherence to maximum width, length, height, and rear overhang limits, which are detailed in Tables 1 to 3 of the Notice. Vehicles must also comply with any relevant conditions in the Escorting Guidelines for Oversize and Overmass Vehicles and Loads in South Australia, and ensure that any load higher than 4.8m is carried on a vehicle or trailer with a deck height no more than 1.2m above the ground. Additionally, eligible vehicles must carry a copy of the Notice at all times and produce it upon request from an authorised officer or police officer. Failure to comply with the conditions of the Notice can result in significant penalties. Under the HVNL, any breach of the Notice can be considered an offence, leading to potential criminal or civil consequences. The Notice itself does not specify the maximum penalties, but breaches of similar provisions in the HVNL can attract fines and, in serious cases, imprisonment. The exact penalties would depend on the nature and severity of the breach, as well as the specific provisions of the HVNL that are applicable.
