Overview

The Solar Observatory Fund Act 1931 was enacted to amend the Solar Observatory Fund Act 1930, aiming to improve the management and reporting of the fund's income and expenditure. This Act was passed by the Parliament of the Commonwealth of Australia and assented to on 13th May, 1931. The principal objective of the Act is to enhance the financial oversight of the Solar Observatory Fund by introducing new procedures for the deposit and expenditure of income derived from investments. The Act mandates that the trustees deposit the net income from investments into a designated account for the Director of the Observatory on a quarterly basis, with a requirement for the Director to report on the use of these funds at the end of each financial year. This legislative amendment ensures greater transparency and accountability in the management of the Fund, aligning with the overarching goal of efficient administration of public resources.

Scope and Application

The Solar Observatory Fund Act 1931 amends the Solar Observatory Fund Act 1930, providing specific provisions regarding the expenditure of income from investments and audit processes. This Act applies to the trustees and the Director of the Solar Observatory Fund, focusing on the management and allocation of funds derived from investments to support the operations of the Observatory. Geographically, the Act operates within the jurisdiction of the Commonwealth of Australia, impacting entities and individuals associated with the management and funding of the Solar Observatory. There are no exclusions or exemptions explicitly stated in the provided text, suggesting that the provisions apply broadly to the specified roles within the context of the Fund. The Act further extends its application through subordinate instruments, which may include regulations or orders that detail specific administrative procedures or additional requirements for compliance.

Key Provisions

The Solar Observatory Fund Act 1931 introduces significant amendments to the Solar Observatory Fund Act 1930, focusing on the management and expenditure of the fund's income. Section 1 of the Act provides the short title and references the Principal Act, which is the Solar Observatory Fund Act 1930 as it was before this amendment. The Act itself is now referred to as the Solar Observatory Fund Act 1930-1931 after incorporation of these changes. Section 2 of the Act repeals Section 9 of the Principal Act and inserts a new section in its place. This new section mandates that at the end of each quarter, the trustees must deposit the net income from investments into a Director’s Account in the Commonwealth Savings Bank. The Director is authorised to use these funds for the purposes of the Observatory. Additionally, the Director must provide a report to the trustees at the beginning of each financial year, detailing the total income deposited, expenditure made, purposes of the expenditure, and any unexpended balance from the previous year. The obligations imposed by the Act are primarily on the trustees and the Director. The trustees are required to ensure that the net income from investments is deposited into the Director’s Account at the end of each quarter. The Director, on the other hand, is responsible for managing the fund’s expenditure for the Observatory’s purposes and reporting on these financial activities to the trustees. This reporting obligation ensures transparency and accountability in the use of the fund’s resources. Regarding consequences for non-compliance, the Act does not explicitly detail offences, penalties, or civil and criminal consequences for breach within the provided text. However, the obligations outlined suggest that failure to comply with the deposit and reporting requirements could lead to potential legal repercussions, as is often the case with financial regulations. The specifics of penalties would typically be found in the relevant financial administration and legislative frameworks in place at the time.
