Overview

The Social Services Legislation Amendment (Cost of Living Concession) Act 2015 was enacted by the Parliament of Australia to address the gap in the existing social security and veterans' entitlement laws concerning the Cost of Living Concession payments made by the Government of South Australia. This Act, which received Royal Assent on 12 November 2015, aims to ensure that these specific payments are appropriately recognised and integrated into the social security framework. The policy objective of this legislation is to provide a clear legal basis for the inclusion of these concessions, thereby ensuring that beneficiaries of social security and veterans’ entitlements receive consistent and fair treatment. The amendments made by this Act apply to payments made before, on, or after the commencement date, ensuring a smooth transition and application of the new provisions.

Scope and Application

The Social Services Legislation Amendment (Cost of Living Concession) Act 2015 is an Act of the Parliament of Australia that seeks to amend the law relating to social security and veterans’ entitlements, specifically to incorporate the Cost of Living Concession payments made by the Government of South Australia into the legislative framework. This Act applies to individuals who are recipients of social security payments and veterans' entitlements as defined in the Social Security Act 1991 and the Veterans’ Entitlements Act 1986, respectively. The amendments made by this Act are intended to ensure that these concessions are appropriately recognised and integrated within the existing legal structure governing social security and veterans' benefits. The Act's amendments apply to payments made before, on, or after the commencement of the Act, thereby ensuring retrospective and prospective coverage. The geographic or jurisdictional reach of this Act is primarily within the Commonwealth of Australia, as it amends federal legislation. However, it specifically references the Cost of Living Concession payments made by the Government of South Australia, indicating that the Act also interfaces with state-level initiatives. The Act does not explicitly state any exclusions, exemptions, or thresholds, but it is understood that its application is contingent on the conditions and eligibility criteria outlined in the Social Security Act 1991 and the Veterans’ Entitlements Act 1986. The Act extends its application through amendments to these existing Acts, thereby integrating state-level concessions into the federal legislative framework.

Key Provisions

The Social Services Legislation Amendment (Cost of Living Concession) Act 2015 (Act) primarily amends the Social Security Act 1991 and the Veterans' Entitlements Act 1986 to include a new type of payment, known as the Cost of Living Concession, made by the Government of South Australia. The Act specifies that these amendments apply to payments made before, on, or after the commencement of this Act (Schedule 1, Item 3). Under the Act, the key obligations for the parties governed by it include the acknowledgment and inclusion of the Cost of Living Concession as a valid payment in the calculation of social security and veterans' entitlements. The Government of South Australia is required to make these payments as specified in the legislation, and the Commonwealth must recognise these payments when determining eligibility and amounts for social security benefits and veterans' entitlements. The Act ensures that these concessions are factored into the means tests and calculations for eligibility, without excluding or reducing the benefits that individuals are entitled to receive. Breaches of the provisions in this Act can result in civil or criminal consequences. Specifically, if any party fails to comply with the obligations to recognise and include the Cost of Living Concession as required, they may face penalties. While the Act does not detail specific penalties, the general legal framework under which it operates may impose fines or other sanctions for non-compliance. The exact penalties would be determined in accordance with the applicable laws and regulations governing social security and veterans' entitlements. This includes potential legal actions that could be taken against entities that do not adhere to the requirements set forth by the Act.
