Overview

The Social Security (Declaration of Visa in a Class of Visas—Newly Arrived Resident’s Waiting Period for Carer Payment) Determination 2000, enacted by Jocelyn Margaret Newman, the Minister for Family and Community Services, addresses the issue of eligibility for Carer Payment by newly arrived residents in Australia. This legislative instrument was introduced to clarify and streamline the waiting period requirements for individuals holding specific visa subclasses, namely subclass 116 (Carer) and subclass 836 (Carer), to ensure they are eligible for the Carer Payment. The enactment by the Minister was aimed at rectifying ambiguities and ensuring that the social security provisions under the Social Security Act 1991 were accurately applied to these newly arrived residents, thereby providing them with the necessary support during their initial settlement period in Australia. This determination also involved the amendment of the Social Security (Newly Arrived Resident’s Waiting Periods) Determination 1997 to omit certain provisions, thereby updating the regulatory framework to reflect current policy objectives and administrative practices.

Scope and Application

The Social Security (Declaration of Visa in a Class of Visas—Newly Arrived Resident’s Waiting Period for Carer Payment) Determination 2000 applies to individuals who have been granted a subclass 116 (Carer) or subclass 836 (Carer) visa. The legislation aims to define the waiting periods for eligibility of Carer Payment for these newly arrived residents, thereby clarifying their entitlement to social security benefits. This determination is significant as it specifies the conditions under which these individuals can access the Carer Payment, ensuring that the social security system supports those who have recently relocated to Australia under these specific visa subclasses. The legislation operates within the Commonwealth jurisdiction, governed by the Social Security Act 1991, and is applicable nationally across Australia. The scope of the determination is limited to the visa subclasses mentioned and does not extend to other types of visas or residents. The primary exclusion is any other visa not listed in the determination, meaning those on different visas or with different immigration statuses are not subject to these specific waiting period rules. The determination also amends previous legislation by omitting the former paragraph (b) of section 2 of the Social Security (Newly Arrived Resident’s Waiting Periods) Determination 1997, thereby refining the application of waiting periods for Carer Payment eligibility. This amendment ensures that the law remains current and accurately reflects the intended policy outcomes for newly arrived residents under the specified carer visas.

Key Provisions

The Social Security (Declaration of Visa in a class of Visas—Newly Arrived Resident’s Waiting Period for Carer Payment) Determination 2000 (the Determination) outlines specific provisions regarding the waiting period for Carer Payment eligibility for newly arrived residents holding certain visas. Under section 201AA(5)(d) of the Social Security Act 1991, this Determination modifies the waiting period for individuals holding a subclass 116 (Carer) or subclass 836 (Carer) visa, clarifying that these visa holders do not have to wait before they can access Carer Payment. This amendment is particularly significant as it removes the previous requirement that newly arrived residents in these visa subclasses had to wait before becoming eligible for Carer Payment. The Determination imposes specific obligations on individuals holding the affected visas. These individuals must ensure that their visa status falls under the specified subclasses, and that they meet all other eligibility criteria for the Carer Payment. The Determination also requires that the relevant authorities, such as Centrelink, recognise and apply the waiting period waiver correctly for those holding subclass 116 or 836 visas. In essence, this means that applicants must provide accurate and complete documentation to substantiate their visa status and eligibility for the Carer Payment. In terms of potential breaches and consequences, the Determination does not explicitly detail offences, penalties, or civil/criminal consequences for non-compliance. However, failure to comply with the requirements set out in the Social Security Act 1991 or to provide accurate information to Centrelink could result in denial of the Carer Payment, and possibly in more severe consequences if fraud or misrepresentation is involved. Centrelink has the authority to investigate and take action against individuals found to have provided false information or engaged in fraudulent activities in their application for social security benefits. Such actions could lead to financial penalties, recovery of payments, and potential legal action under the relevant legislation.
