Overview

The Social Security (Coronavirus Economic Response—2020 Measures No. 6) Determination 2020 was enacted to address the economic impacts of the COVID-19 pandemic on Australians by providing temporary financial support to eligible individuals. This determination was made under subsection 1210B(2) of the Social Security Act 1991 and was issued by the relevant authorities to ensure that vulnerable Australians received adequate assistance during this unprecedented period. The primary objective of this legislative instrument was to introduce temporary economic measures, including a COVID-19 supplement for widow allowance, partner allowance, and special benefit, to alleviate the financial burden on those affected by the pandemic. The determination specifies that the supplement would be applicable for the period starting on 25 September 2020 and ending on 31 December 2020, with a fortnightly amount of $250 for each eligible instalment period.

Scope and Application

The Social Security (Coronavirus Economic Response—2020 Measures No. 6) Determination 2020 is a legislative instrument made under the Social Security Act 1991, designed to provide targeted economic relief measures in response to the COVID-19 pandemic. This determination applies to individuals who are eligible for widow allowance, partner allowance, and special benefit, providing them with a COVID-19 supplement to support their financial needs during the specified period. The period covered by this determination commences on 25 September 2020 and concludes at the end of 31 December 2020. The fortnightly amount of the COVID-19 supplement for eligible persons during this period is set at $250. The determination operates nationally within Australia and applies to all individuals who meet the eligibility criteria for the specified benefits. Subordinate instruments or regulations may further define or modify the application of this determination, but the primary scope and provisions are detailed within the determination itself.

Key Provisions

The Social Security (Coronavirus Economic Response—2020 Measures No. 6) Determination 2020 (sections 1-4) introduces temporary measures to support individuals affected by the COVID-19 pandemic. Specifically, it determines the widow allowance, partner allowance, and special benefit under the Social Security Act 1991 for a period beginning on 25 September 2020 and ending on 31 December 2020 (section 4(2)). Additionally, it sets the fortnightly amount of the COVID-19 supplement at $250 for instalment periods beginning on or after 25 September 2020 and before the end of 31 December 2020 (section 4(3)). The Act imposes several obligations on the relevant parties. Primarily, it mandates the determination of specific social security benefits for the specified period and sets the amount of the COVID-19 supplement for that period. It is essential for those eligible to apply for these benefits within the timeframe specified by the determination to receive the support intended by this legislation. The determination does not explicitly outline specific offences, penalties, or consequences for breaches. However, any failure to comply with the conditions or provisions of this determination could potentially lead to legal repercussions under the broader framework of the Social Security Act 1991. Penalties for non-compliance with social security laws can include fines, recovery of payments, and other civil or administrative actions as stipulated by the Act. It is also important to note that the Social Security Act 1991 includes general provisions for enforcement and compliance, which may apply in cases of non-compliance with the determination.
