Overview

The Social Security (Administration) (Vulnerable income management areas) Specification 2012, as amended by the Social Security (Administration) (Specified vulnerable and declared voluntary income management areas) Amendment Determination 2013, was introduced to address the problem of ensuring that certain vulnerable groups receive their social security payments in a way that promotes responsible financial behaviour. This legislative instrument is made under subsections 123UCA(3) and 123UGB(2) of the Social Security (Administration) Act 1999 and was enacted by the Parliament of Australia. The policy objective is to target specific areas identified as vulnerable, where recipients of social security payments will be subject to income management measures, ensuring their payments are used in a manner that supports their welfare and financial stability. The Specification identifies particular local government areas in each state and territory of Australia where these measures will apply.

Scope and Application

The Social Security (Administration) (Vulnerable income management areas) Specification 2012, as amended, applies to particular geographical areas in Australia identified as vulnerable income management areas, under the Social Security (Administration) Act 1999. This legislation specifically targets welfare payment recipients in these designated areas to help manage their income effectively. The Act applies to persons who are welfare payment recipients and reside within the specified areas of New South Wales, Queensland, South Australia, Victoria, and the Northern Territory. The geographic reach of this legislation is nationwide, affecting multiple states and territories. The specified areas are defined according to local government acts in each state and territory, ensuring the legislation aligns with local administrative boundaries. There are no stated exclusions or exemptions within the text, although the application of the Act may be influenced by subordinate instruments or further amendments. The Act’s application may also be extended or restricted through subsequent legislative determinations, as evidenced by the amendment made by the Social Security (Administration) (Specified vulnerable and declared voluntary income management areas) Amendment Determination 2013.

Key Provisions

The main sections of the Social Security (Administration) (Vulnerable income management areas) Specification 2012 (F2012L01614) define the areas across various Australian states that are considered vulnerable for the purposes of income management under the Social Security (Administration) Act 1999. Section 5 specifies areas in New South Wales, section 6 lists areas in Queensland, section 7 identifies areas in South Australia, section 8 specifies areas in Victoria, and section 9 identifies the entire Northern Territory as a vulnerable income management area (subsections 5(1), 6(1), 7(1), 8(1)). The Specification commenced on 27 July 2012 and revoked the previous Social Security (Administration) (Classes of Exempt Welfare Payment Recipients) Specification 2012. Each area is defined according to the respective state’s Local Government Act. The obligations and requirements imposed by the Act on the parties or entities it governs include the implementation of vulnerable income management strategies in the specified areas. Welfare recipients in these areas are subject to special financial management practices aimed at ensuring their welfare payments are used appropriately. This involves the use of a Commonwealth-issued Commonwealth Payment Card, which restricts spending on certain items such as alcohol, gambling, and tobacco, unless approved by a social worker or case manager. The Act also mandates that welfare recipients in these areas must engage with service providers to develop and adhere to a financial management plan. Any breaches of the obligations or requirements set out in the Act may result in civil or criminal consequences. The Act does not specify particular offences or penalties but refers to the broader Social Security (Administration) Act 1999, which provides for a range of penalties. These can include fines, imprisonment, or other penalties for non-compliance with income management requirements. The maximum penalties for serious breaches could involve substantial fines and periods of imprisonment, depending on the severity of the breach and the specific provisions of the broader Act.
