Overview

The Social Security (Administration) (Specified Income Management Territory – Northern Territory) Instrument 2023 was enacted to address the need for specified income management measures in the Northern Territory under the Social Security (Administration) Act 1999. This legislative instrument was made under subsections 123UCB(4) and 123UCC(4) of the Act and specifies the Northern Territory as a territory for disengaged youth income management and long-term welfare payment recipient income management. The instrument aims to provide targeted assistance and compliance measures to support social security recipients in the specified areas. The enacting body is the Australian Parliament, which authorised the creation of this instrument to implement policy objectives related to income management in the Northern Territory. This compilation of the instrument reflects the current legal status as of 27 June 2026, including any amendments up to that date. The text does not show the effect of uncommenced amendments, which can be found on the legislative register. The endnotes provide details about the amendment history, legislative changes, and the status of any provisions that have been repealed or modified but not yet amended in the text of the compiled law. This compilation serves as a comprehensive record of the instrument’s application and legislative history, ensuring practitioners have access to the most current legal framework governing specified income management in the Northern Territory.

Scope and Application

The Social Security (Administration) (Specified Income Management Territory – Northern Territory) Instrument 2023 applies to the Northern Territory for specified income management purposes under the Social Security (Administration) Act 1999. This instrument identifies the Northern Territory as the specified area for the application of income management measures targeted at disengaged youth and long-term welfare payment recipients, as defined under the Act. The instrument specifies the territories where these income management provisions will be implemented and thereby establishes the geographic reach of these provisions, limited to the Northern Territory. There are no stated exclusions, exemptions, or thresholds within the instrument itself, though these may be detailed in subordinate instruments or other related legislation. The application and effectiveness of this instrument may also be influenced by any application, saving, or transitional provisions that are not included in this compilation but are referenced in the endnotes. Any modifications or amendments to this instrument that affect its operation are accessible on the Register of Legislation.

Key Provisions

The Social Security (Administration) (Specified Income Management Territory – Northern Territory) Instrument 2023, made under subsections 123UCB(4) and 123UCC(4) of the Social Security (Administration) Act 1999, designates the Northern Territory for specified income management purposes, as outlined in sections 7 and 8. Section 7 specifies the Northern Territory for the purposes of paragraph 123UCB(1)(c) of the Act, which relates to disengaged youth income management. Section 8, on the other hand, specifies the Northern Territory for the purposes of paragraph 123UCC(1)(c) of the Act, which concerns long-term welfare payment recipient income management. These sections essentially clarify that the Northern Territory is the designated area where these specific income management measures will be applied. Under this instrument, certain obligations and requirements are imposed on the parties or entities it governs. For instance, service providers responsible for administering income management in the Northern Territory must comply with the detailed procedures and protocols established under the Act. These include, but are not limited to, the implementation of income management plans for disengaged youth and long-term welfare payment recipients, ensuring compliance with the specified conditions, and reporting mechanisms for monitoring and evaluating the effectiveness of these measures. In terms of penalties and consequences for non-compliance, the instrument does not explicitly detail the specific penalties within the text. However, breaches of the Social Security (Administration) Act 1999 or its related instruments generally may result in substantial penalties. Typically, these can include financial penalties for individuals and organisations, which may vary depending on the severity and frequency of the breach. In more serious cases, criminal charges could be pursued, leading to potential imprisonment. The exact penalties would be determined based on the specific provisions of the Act and any related amendments or regulations.
