Overview
The Social Security (Administration) (Declared voluntary income management areas — Western Australia) Determination 2011, as amended, was introduced to address specific issues within certain areas of Western Australia where there was a need for targeted financial management to support welfare recipients. This legislative instrument was made under the authority of paragraph 123TGA(c) of the Social Security (Administration) Act 1999, which allows for the declaration of voluntary income management areas to ensure that welfare recipients, particularly those in remote or disadvantaged communities, use their payments in a way that best supports their wellbeing and that of their families. The enactment of this legislation by the Parliament of Australia aims to provide a structured financial management framework that assists in preventing misuse of welfare funds and encourages better financial habits among welfare recipients. This determination specifically identifies various areas in Western Australia as those where such measures would be most beneficial, facilitating a more effective administration of social security benefits in those regions.
Scope and Application
The Social Security (Administration) (Declared voluntary income management areas — Western Australia) Determination 2011, as amended, applies to specific geographic areas within Western Australia for the purposes of implementing voluntary income management under Part 3B of the Social Security (Administration) Act 1999. This Determination identifies certain postcodes in Western Australia as declared voluntary income management areas where the provisions of the Act can be applied. The Determination revokes the previous determination from 2009, which had covered different areas, and amends the current determination to include additional areas through the Social Security (Administration) (Declared voluntary income management areas — Western Australia) Amendment Determination 2012. The geographic reach of this Determination is confined to the specified postcodes within Western Australia, and it does not explicitly state any exclusions or exemptions, though the application of the Act itself may include such provisions. The application of this Determination is further refined through subordinate instruments which specify the exact areas and postcodes to which the Act applies.
Key Provisions
The Social Security (Administration) (Declared voluntary income management areas — Western Australia) Determination 2011, as amended, under section 123TGA(c) of the Social Security (Administration) Act 1999, designates specific areas in Western Australia as voluntary income management areas. This legislative instrument, which came into effect on 28 November 2011, is designed to provide a framework for managing income in certain areas, potentially to improve financial outcomes for beneficiaries of social security payments. The areas covered include Cannington, Joondalup, Midland, Mirrabooka, Armadale, Fremantle, Rockingham, Perth, Kimberley, and Peel. Each of these areas is identified by a specific set of postcodes, aligning with those allocated by Australia Post.
The Act imposes several obligations on the parties involved, primarily ensuring that the management of income in these declared areas adheres to the guidelines and objectives set forth in the Social Security (Administration) Act 1999. Beneficiaries residing in these areas may be required to participate in income management programs designed to help them better manage their finances, thereby reducing debt and improving their financial stability. Additionally, the Department of Human Services is mandated to implement these programs and monitor compliance within these designated areas.
Breach of the provisions outlined in this Determination can lead to various civil and criminal consequences. While specific penalties are not detailed in this Determination, it is likely that penalties for non-compliance with the Social Security (Administration) Act 1999 would apply. Generally, penalties for contravening social security laws can include fines and, in severe cases, imprisonment. For instance, section 167 of the Act provides for penalties including fines of up to $22,200 for individuals and $111,000 for bodies corporate, depending on the nature and severity of the breach. These penalties underscore the importance of adhering to the requirements set forth in the Determination.
