Overview

The Social Security Act 1991, enacted by the Commonwealth Parliament, serves to provide a safety net of payments to support Australians who are in need of financial assistance due to various circumstances such as unemployment, illness, disability, or family responsibilities. The Act addresses the gap in social support by offering a range of benefits and services designed to alleviate financial hardship and promote social inclusion. One particular legislative instrument under this Act, F2008B00409, identifies the Minister for Social Security's approval of the Individual, Family and Carer Support Grants Scheme, operated by the Disability Services Commission in Western Australia, as an approved scheme from 3 November 1995. This approval aligns with the policy objective of the Act to provide comprehensive and coordinated support for individuals and families facing disability-related challenges.

Scope and Application

The Social Security Act 1991, as applied by the legislative instrument F2008B00409, identifies the Individual, Family and Carer Support Grants Scheme operated by the Disability Services Commission, Government of Western Australia, as an approved scheme for the purposes of the Act. This legislative instrument, dated 25 April 1996, provides that the scheme has been approved with effect from 3 November 1995, thereby recognising the scheme’s compliance with the Act's requirements. The Act applies to the entities involved in the administration of the scheme, specifically the Disability Services Commission, which is a government body in Western Australia, and potentially to individuals or families who are beneficiaries of the scheme. The geographic reach of this approval is limited to the jurisdiction of Western Australia, although the Act itself is a Commonwealth Act and thus generally applies across Australia. The approval does not specify any exclusions, exemptions, or thresholds within this legislative instrument, although the broader Act may include such provisions. The Act's application may be further extended or restricted through subordinate instruments, which are not detailed in this specific notice.

Key Provisions

The primary operative sections of the legislation (Section 35A) determine the approval of a specific scheme, namely the Individual, Family and Carer Support Grants Scheme, operated by the Disability Services Commission in Western Australia. This approval is effective from 3 November 1995, indicating that the scheme is recognised and endorsed under the Social Security Act 1991. The approval of this scheme means that the benefits and support provided through this mechanism are aligned with the objectives and requirements of the Social Security Act 1991, ensuring that they meet the legislative standards for social security support in Australia. The obligations and requirements imposed by this legislation on the parties involved are primarily centred around the compliance and operational standards set by the Social Security Act 1991. The Disability Services Commission, as the operator of the approved scheme, must ensure that the grants and support provided adhere to the legislative framework. This includes maintaining accurate records, providing timely assistance, and ensuring that all recipients are assessed and supported in accordance with the criteria and guidelines outlined in the Act. Furthermore, the Commission must regularly report to the Minister for Social Security on the implementation and effectiveness of the scheme, ensuring transparency and accountability in the delivery of social security support. The legislation also outlines the potential consequences for non-compliance or breaches of the Act. Any party found to be in breach of the requirements or obligations set out in the Social Security Act 1991 may face various penalties and legal consequences. For instance, the Act may provide for financial penalties, administrative actions, or even the revocation of the scheme's approval. The specific penalties and consequences would depend on the nature and severity of the breach, with the potential for significant repercussions for the parties involved. It is essential for the Disability Services Commission to adhere strictly to the provisions of the Act to avoid any adverse outcomes and to maintain the integrity of the approved scheme.
