REGULATIONS (REPEAL)

The Services Canteens Trust Fund Regulations, made under section 36 of the Services Trust Fund Act 1947 (“the Act”) provide for the administration and organisation of meetings by the trustees of the Services Canteens Trust Fund which was established under Part III of the Act.

Section 73 of the Defence Legislation Amendment Act 1987 has now repealed Part III of the Act, and as a consequence the Services Canteens Trust Fund Regulations are no longer operative.

This Statutory Rule repeals the Services Canteens Trust Fund Regulations.

Commencement

This Statutory Rule comes into operation on the date of gazettal.

Overview

The Services Canteens Trust Fund Regulations (Repeal) Statutory Rules 1988 were introduced to address the obsolescence of certain regulations related to the administration of the Services Canteens Trust Fund, which was established under the Services Trust Fund Act 1947. The repeal of Part III of the Act through the Defence Legislation Amendment Act 1987 rendered the existing regulations redundant, leading to the issuance of these Statutory Rules to formally repeal the Services Canteens Trust Fund Regulations. These regulations were enacted by the authority of the Minister for Defence Science and Personnel to ensure that the legal framework remains current and effective in light of legislative changes. The objective of these Statutory Rules is to remove outdated regulatory provisions that no longer serve a purpose under the revised legislative context, thereby maintaining the integrity and efficiency of the legal system.

Scope and Application

The Services Canteens Trust Fund Regulations (Repeal) Statutory Rule 1988, issued under the authority of the Minister for Defence Science and Personnel, pertains to the repeal of existing regulations concerning the administration and organisation of meetings by the trustees of the Services Canteens Trust Fund. This repeal follows the legislative action in the Defence Legislation Amendment Act 1987, which effectively repealed Part III of the Services Trust Fund Act 1947, thereby rendering the associated regulations obsolete. The repealing Statutory Rule aligns with this legislative change and nullifies the previously established Services Canteens Trust Fund Regulations. It is applicable to the trustees of the Fund and those involved in the administration of its operations, within the jurisdictional reach of the Commonwealth of Australia. Notably, the repeal does not introduce any new exclusions, exemptions, or thresholds but rather reflects the current legislative intent by removing outdated regulatory provisions. This Statutory Rule commences on the date of its gazette, ensuring immediate effect upon publication.

Key Provisions

The primary operative sections of the Services Canteens Trust Fund Regulations (repealed) pertain to the administration and organisation of meetings by the trustees of the Services Canteens Trust Fund, as stipulated in section 36 of the Services Trust Fund Act 1947 (1). These regulations were intended to guide the trustees in their management of the fund, which was established under Part III of the Act (2). However, section 73 of the Defence Legislation Amendment Act 1987 has led to the repeal of Part III of the Act, thereby rendering these regulations obsolete (3). Consequently, the Statutory Rule issued under the authority of the Minister for Defence Science and Personnel, repeals the Services Canteens Trust Fund Regulations (4). These repealed regulations imposed certain obligations and requirements on the trustees of the Services Canteens Trust Fund. They were expected to adhere to the provisions outlined in the regulations to ensure the proper administration of the fund (5). These obligations would have included maintaining financial records, ensuring transparency in the fund's operations, and facilitating regular meetings to discuss and decide on the fund's activities and financial management (6). The trustees would also have been responsible for reporting to relevant authorities and ensuring compliance with any applicable laws and regulations (7). With the repeal of the Services Canteens Trust Fund Regulations, any previous obligations or requirements that were imposed on the trustees by these regulations are no longer in effect (8). The repeal signifies that the trustees are no longer bound by the specific administrative and organisational directives that were previously outlined in the regulations (9). It is important for the trustees to be aware of this change and to ensure that they are operating in accordance with any new or existing laws and regulations that may apply to the fund (10). Under the repealed Services Canteens Trust Fund Regulations, there were no explicit provisions detailing offences, penalties, or consequences for breach (11). However, it is likely that any breaches of the regulations would have been subject to the general legal consequences applicable under the Services Trust Fund Act 1947 or other relevant legislation (12). Given the repeal of the regulations, any previous penalties or consequences for non-compliance with these specific provisions are no longer applicable (13). Trustees and other parties involved with the fund should now focus on adhering to any new or existing laws and regulations that may have taken the place of these repealed provisions (14). The Statutory Rule that repeals the Services Canteens Trust Fund Regulations comes into operation on the date of its gazettal (15). This means that from the moment the rule is officially published, the regulations are no longer in force, and the trustees and other relevant parties must adjust their practices and operations accordingly (16). It is crucial for those affected by this repeal to ensure that they are aware of the changes and to take any necessary steps to comply with any new or existing laws and regulations that may apply to the administration of the Services Canteens Trust Fund (17).
