Overview

Statutory Rules 1974 No. 33, made under the Science and Industry Research Act 1949-1973, represents an amendment to the existing regulations governing the appointment and remuneration of officers within the science and industry research sector. Enacted by the Governor-General on 14 March 1974, the regulation responds to the need for updating the financial provisions tied to these appointments. The Science and Industry Research Act, originally enacted in 1949, was designed to facilitate and support research and development in science and industry, aiming to foster innovation and technological advancement in Australia. The specific amendment to the Science and Industry Research Regulations increases the monetary limit for officers' appointments from sixteen thousand three hundred and seventeen dollars to twenty thousand and five dollars, reflecting the evolving economic landscape and the need for adequate compensation to attract qualified personnel. This adjustment was made to ensure that the remuneration remains competitive and sufficient for the roles, thereby supporting the broader policy objective of the Act to promote and support research and development in science and industry.

Scope and Application

The Science and Industry Research Regulations 1974, made under the Science and Industry Research Act 1949-1973, serve to modify the existing regulatory framework concerning the appointment and remuneration of officers involved in scientific and industrial research within Australia. These regulations apply to individuals and entities engaged in or overseeing research activities, ensuring that the administrative and financial aspects of such roles are appropriately managed. The geographic reach of these regulations is national, applying across all states and territories within Australia, thereby providing a uniform standard for the conduct of research-related activities. Notably, the amendments in this particular regulation concern the financial remuneration of officers, specifically adjusting the monetary amount from sixteen thousand three hundred and seventeen dollars to twenty thousand and five dollars. This adjustment reflects changes in the economic conditions or the value of the role within the research sector. While the regulations are comprehensive, they may be further extended or restricted by subordinate instruments as necessary to adapt to evolving research landscapes and financial contexts.

Key Provisions

The main operative sections of this legislative instrument pertain to the amendment of the Science and Industry Research Regulations under the Science and Industry Research Act 1949-1973 (section 1). Specifically, Regulation 6, which concerns the appointment and other matters relating to officers, is amended to update the monetary figures stipulated within it. The regulation, as amended, now specifies an amount of “Twenty thousand and five dollars” instead of the previously set figure of “Sixteen thousand three hundred and seventeen dollars” (Regulation 6). The Act imposes several obligations on the parties it governs, primarily through the amended Regulation 6. The updated monetary figure may impact the allowances, remunerations, or other financial provisions related to the officers appointed under the Science and Industry Research Regulations. This amendment is intended to ensure that the financial provisions remain current and reflective of the economic conditions or other relevant factors at the time of the amendment. There are no specific offences, penalties, or civil or criminal consequences outlined in the legislative instrument for breaches of the amended Regulation 6. However, any failure to comply with the updated financial provisions could potentially lead to disputes or challenges regarding the remuneration or allowances of officers appointed under the Science and Industry Research Regulations. Such disputes could be subject to resolution through the relevant administrative or judicial processes, but the instrument itself does not detail any specific penalties for non-compliance. In summary, the legislative instrument amends Regulation 6 of the Science and Industry Research Regulations to update the monetary figure from “Sixteen thousand three hundred and seventeen dollars” to “Twenty thousand and five dollars”. This amendment imposes a requirement on the parties governed by the Act to adhere to the updated financial provisions in their dealings with officers appointed under the Science and Industry Research Regulations. While the instrument does not specify any penalties for non-compliance, any failure to adhere to the updated financial provisions could potentially lead to disputes or other consequences.
