Overview
Statutory Rules 1976 No. 72, known as the Regulations under the Science and Industry Research Act 1949-1973, was enacted by the Governor-General of the Commonwealth of Australia, acting with the advice of the Executive Council, to amend the Science and Industry Research Regulations. The primary purpose of these regulations is to update and refine the administration and financial allowances associated with state committees and officers under the Science and Industry Research Act 1949-1973. This legislative instrument addresses the need to adjust monetary figures to reflect contemporary economic conditions, ensuring that allowances and remunerations are appropriately aligned with current standards. These amendments were designed to maintain the effectiveness and relevance of the regulatory framework supporting scientific and industrial research activities in Australia.
Scope and Application
The Science and Industry Research Regulations 1976 are made under the Science and Industry Research Act 1949-1973 and apply to the officers and committees established under that Act, including members of the State Committee, who are tasked with managing and overseeing scientific research initiatives funded by the Commonwealth Government. These Regulations are designed to govern the operational and financial aspects of these committees and officers, ensuring that they function within the legislative framework provided by the Act. The Regulations cover aspects such as the travelling allowance payable to members of the State Committee and the financial limits for officers' appointments, thus affecting both the conduct and administrative processes of research entities supported by the Commonwealth. The Regulations have a national reach as they apply across the Commonwealth of Australia, and they are subject to amendments through subordinate instruments as evidenced by the adjustments to financial allowances and officer remuneration detailed in the Regulations.
Key Provisions
The Science and Industry Research Regulations 1976 primarily revise the financial allowances provided to members of a State Committee and the salary for officers appointed under the Science and Industry Research Act 1949-1973. Regulation 5(1) adjusts the travelling allowance payable to members of a State Committee from Twenty-eight dollars to $37, with the amendment deemed to have taken effect from 1 March 1975. Regulation 6(2) updates the salary for officers from Twenty thousand and five dollars to $24,610. These amendments are designed to reflect current economic conditions and ensure appropriate remuneration for those involved in scientific and industrial research activities.
The obligations imposed by these Regulations primarily focus on ensuring that the financial allowances and salaries are updated to reflect current economic standards. This involves the administrative responsibility of the Governor-General, acting with the advice of the Executive Council, to amend the Regulations as necessary. The amendment of Regulation 5(1) ensures that members of the State Committee receive an updated travelling allowance, which is crucial for their participation in committee activities. Similarly, the amendment of Regulation 6(2) ensures that officers appointed under the Act receive a salary that is reflective of the current economic environment.
Failure to comply with the provisions of these Regulations could result in various consequences. Although specific offences, penalties, or civil/criminal consequences are not explicitly stated in the text, breaches of statutory obligations under the Science and Industry Research Act 1949-1973 could potentially lead to legal action. The penalties for such breaches would be determined by the relevant courts and could include fines or other penalties as deemed appropriate by the judicial authorities. It is essential for all parties involved to adhere to the updated allowances and salaries as stipulated in the Regulations to avoid any legal repercussions.
