Overview

The Sale of Tobacco Regulations 2004, enacted under the Sale of Tobacco Act 2004, was introduced to regulate the sale of tobacco products on Norfolk Island. The Norfolk Island Legislative Assembly enacted these regulations to address the public health concerns associated with tobacco use and to provide a framework for the implementation of tobacco control measures in accordance with the Sale of Tobacco Act. The policy objective behind these regulations is to reduce the prevalence of smoking and its associated health risks by restricting tobacco sales and advertising, thus protecting public health. These regulations outline specific requirements for signs on vending machines and in smoke-free areas, and establish measures to obscure tobacco advertisements. The Sale of Tobacco Regulations 2004, as amended by the Norfolk Island Continued Laws Amendment Ordinance 2015 and subsequent amendments, provide detailed specifications for the physical dimensions and content of signs used for tobacco vending machines and smoke-free areas. The regulations mandate that vending machine signs must be A4 size with specific wording and font requirements, while smoke-free area signs must also meet size and content criteria, including a "no smoking" symbol and specified wording. The regulations were designed to ensure clear and consistent communication of tobacco control measures, thereby supporting the objectives of the Sale of Tobacco Act to reduce tobacco use and its associated health impacts on Norfolk Island.

Scope and Application

The Sale of Tobacco Regulations 2004 apply to Norfolk Island and are made under the authority of the Sale of Tobacco Act 2004. These regulations govern the sale of tobacco products on the island, aiming to regulate signage and advertising requirements. They apply to any person or entity involved in the sale or distribution of tobacco products on Norfolk Island. The regulations specify the dimensions and content of signs required on vending machines and in smoke-free areas, ensuring clear and visible warnings about the legal restrictions and penalties associated with tobacco sales and smoking. The geographic reach of these regulations is limited to Norfolk Island, and they do not extend beyond its jurisdictional boundaries. The regulations do not include any specific exclusions or thresholds but are comprehensive in their application to all tobacco-related sales and advertising on the island. Any further application or clarification of these regulations may be provided through subordinate instruments, as permitted under the Norfolk Island Continued Laws Ordinance 2015.

Key Provisions

The Sale of Tobacco Regulations 2004 (Norfolk Island) primarily govern the sale of tobacco products and the display of tobacco advertisements on Norfolk Island. Section 4 of these regulations requires that vending machines selling tobacco products must display a notice informing persons under 18 years of age that they must not operate the machine, and that penalties apply under the Sale of Tobacco Act 2004. This notice must be in a specific size and format, with particular wording and font size. Section 5 deals with the obscuring of tobacco advertisements, allowing them to be painted over or covered with an opaque material, with the requirement that this be done within 36 hours. Section 6 sets out the requirements for signs in smoke-free areas, stipulating that these signs must also be of a specific size and format, and include a "no smoking" symbol and specific wording, all printed in the required font size. These regulations impose several obligations on parties and entities involved in the sale and advertisement of tobacco products on Norfolk Island. Firstly, those operating vending machines that sell tobacco products must ensure that the mandated notice is displayed correctly on the machine (Regulation 4). This includes adhering to the size, format, and wording specifications outlined in the regulation. Additionally, entities responsible for tobacco advertisements must ensure that any advertisements are obscured within 36 hours as per Regulation 5. For smoke-free areas, those responsible for the signage must display signs that meet the criteria set out in Regulation 6, ensuring they are visible and correctly formatted. Failure to comply with the Sale of Tobacco Regulations 2004 can result in various legal consequences. According to the Sale of Tobacco Act 2004, penalties can be imposed for non-compliance with these regulations. While the specific penalties are not detailed within the Sale of Tobacco Regulations 2004 themselves, it is clear that breaches of these regulations can lead to enforcement actions under the overarching Act. This could potentially include fines or other sanctions as determined by the relevant authorities on Norfolk Island. It is crucial for businesses and individuals to adhere to these regulations to avoid any legal repercussions.
