Sale of Tobacco Regulations 2004

Regulations No. 11 of 2004

 

Short title

 1. These Regulations may be cited as the Sale of Tobacco Regulations 2004.

Reference to Sale of Tobacco Act

 2. In these regulations reference to “the Act” is reference to the Sale of Tobacco Act 2004.

Signs on vending machines

 4. For the purpose of subsection 9(2) of the Act a notice must be not less than 210 millimetres wide and 297 millimetres high (A4 size) with the words 

(a) “persons under 18 years must not operate this machine”; and

(b) “penalties apply” and “Sale of Tobacco Act 2004”,

printed in black on a white background in plain block letters of a height not less than 4 centimetres.

Obscuring advertising

 5. For the purpose of subsection 15(1) of the Act 

(a) a tobacco advertisement may be obscured by 

(i) painting; or

(ii) covering

with an opaque substance or material that effectively hides the advertisement; and

(b) the specified period is 36 hours.

Content of signs in smoke free area

 6. For the purposes of subsection 18(1) of the Act a sign must be not less than 210 millimetres wide and 297 millimetres high (A4 size) and must contain 

(a) a “no smoking” symbol in the form of a circle with a diagonal line printed in red over a depiction of a cigarette and smoke printed in black; and

(b) the words 

“no smoking” or “smoking prohibited” 

printed in black on a white background in plain block letters of a height not less than 3 centimetres ;and

(c) “penalties apply” and “Sale of Tobacco Act 2004 

printed in black on a white background in plain block letters of a height not less than 1 centimetre.
