Overview

The Salaries (Statutory Offices) Adjustment Act 1971 was enacted to address the need for adjusting the remuneration and allowances for holders of certain statutory offices. This Act was passed by the Parliament of Australia and received Royal Assent on 16 December 1971. The primary objective of the Act is to amend various other Acts to update the financial provisions relating to the remuneration and allowances for specified officeholders. This includes adjusting the salary rates and allowances for individuals such as the Chairman and members of the Australian Broadcasting Control Board and the Australian Broadcasting Commission, the general manager of the Australian Broadcasting Commission, and the Commissioner for Employees’ Compensation, among others. The Act ensures that the compensation for these positions is in line with the legislative intent and the economic conditions of the time.

Scope and Application

The Salaries (Statutory Offices) Adjustment Act 1971 is an Act of the Commonwealth of Australia that pertains to the remuneration and allowances payable to the holders of certain statutory offices. The Act applies to specified statutory offices across various Acts, including the Australian Wool Commission Act 1970, Broadcasting and Television Act 1942–1969, Compensation (Commonwealth Employees) Act 1971, and Criminology Research Act 1971. It outlines the specific remuneration rates and conditions for the offices of Chairman, members, and deputies within these Acts. The Act’s amendments to the Criminology Research Act 1971 take effect upon the coming into operation of that Act. The Act comes into operation on the day it receives Royal Assent, with specific provisions for the amendment of other Acts. It includes detailed amendments to the remuneration and allowances for various positions, specifying exact figures and conditions. No explicit exclusions, exemptions, or thresholds are stated within the text, and it does not extend or restrict application through subordinate instruments.

Key Provisions

The Salaries (Statutory Offices) Adjustment Act 1971 (section 1) amends various Acts to adjust the remuneration and allowances payable to the holders of certain statutory offices. The Act primarily operates by amending specified sections in other Acts to update the remuneration rates for office holders (section 3). For instance, section 12 of the Australian Wool Commission Act 1970 is amended to set the remuneration for members of the Commission at Two thousand six hundred dollars per year, with specific provisions for the Chairman and deputies (First Schedule, section 3). Similarly, the Broadcasting and Television Act (No. 2) 1971 is amended to set the remuneration for the Chairman and members of the Australian Broadcasting Control Board and the Australian Broadcasting Commission (First Schedule, sections 11 and 33). The Act imposes specific obligations on the parties it governs. For example, it mandates that the Chairman of the Australian Broadcasting Control Board shall be paid remuneration at the rate of Seventeen thousand nine hundred and forty-seven dollars a year, while other members shall receive Fifteen thousand three hundred and seventy dollars per year (First Schedule, section 11). Furthermore, the Act requires that the Commissioner for Employees’ Compensation shall be paid a salary of Fourteen thousand seven hundred and twenty-seven dollars per year, with allowances provided by Parliament (First Schedule, section 11). These amendments are intended to ensure that the remuneration reflects current standards and economic conditions. Breaches of the provisions outlined in the Act may lead to various civil or criminal consequences, depending on the severity and intent of the violation. While the Act does not explicitly state penalties for non-compliance, the failure to adhere to the amended remuneration rates could potentially result in legal disputes or administrative penalties. The precise consequences would be determined by the courts or relevant authorities in the context of the specific breach. The Act’s focus, however, is on ensuring that statutory office holders are appropriately compensated in line with the legislative amendments.
