Overview

The Salaries (Statutory Offices) Adjustment Act 1947 was enacted to address the issue of updating the salaries of holders of certain statutory offices. The Act was passed by the Parliament of Australia and received royal assent on 1st November, 1947. It aimed to increase the salaries payable to the holders of specific statutory offices in order to reflect changes in the cost of living and other economic factors. The Act also repealed the Arbitration (Public Service) Act 1911 and amended various other acts to reflect the updated salaries. The policy objective of the Act was to ensure that the salaries of statutory office holders were fair and commensurate with their responsibilities.

Scope and Application

The Salaries (Statutory Offices) Adjustment Act 1947 applies to the holders of certain statutory offices within the Commonwealth of Australia, including the Chief Justice of the High Court, Justices of the High Court, Chief Judge and Judges of the Commonwealth Court of Conciliation and Arbitration, Judges of the Federal Court of Bankruptcy, Judges of the Supreme Court of the Australian Capital Territory, Public Service Arbitrators, Chairman and Members of the Public Service Board, Commissioner and Assistant Commissioner of Land Tax, Auditor-General, Chairman and Members of the Tariff Board. This Act amends various legislative instruments to adjust the salaries of these officials. The Act's amendments take effect from the day of Royal Assent, with increased salaries deemed to have been payable from the first day of July 1947. The Act extends its reach to the national level, encompassing all statutory offices within the Commonwealth as specified in the schedules. There are no stated exclusions, exemptions, or thresholds within the primary Act itself, although specific details of the salary adjustments are detailed in the schedules. Subordinate instruments may further extend or restrict the application of this Act, but such provisions are not outlined in the primary text.

Key Provisions

The Salaries (Statutory Offices) Adjustment Act 1947 (Sections 1-5) enacts provisions to increase the salaries payable to holders of certain statutory offices. Section 1 provides the short title of the Act, while Section 2 sets the commencement date, with salary increases deemed to apply from July 1, 1947. Section 3 repeals the Arbitration (Public Service) Act 1911, and Section 4 specifies amendments to various Acts to adjust the salaries or allowances of officeholders as detailed in the First Schedule. Section 5 outlines the citation of the amended Acts as listed in the Second Schedule. The obligations imposed by the Act require the specified offices to receive increased salaries as per the amendments detailed in the First Schedule. For instance, the Chief Justice of the High Court's salary increases from £3,500 to £4,500 (Section 4, First Schedule). Similarly, the salary for the Chief Judge of the Commonwealth Court of Conciliation and Arbitration increases from £3,000 to £4,000, and the Judge of the Federal Court of Bankruptcy's salary increases from £2,500 to £3,500. These changes apply to various offices including those in the Public Service, Judiciary, and other statutory bodies. Failure to comply with the provisions of this Act could lead to legal consequences. Although the Act does not explicitly state penalties for non-compliance, it is likely that non-payment of the adjusted salaries could result in legal action or administrative consequences for the responsible authorities. Given the legislative nature, any breaches could be subject to judicial review or enforcement actions under relevant laws. The Act also includes administrative amendments to other statutes, such as omitting subsections in the Commonwealth Conciliation and Arbitration Act 1947 and the War Service Homes Act 1947, as noted in Sections 5(2) and 5(3). These amendments streamline the legislative framework by aligning citations and removing redundant provisions. In summary, the Salaries (Statutory Offices) Adjustment Act 1947 mandates salary increases for various statutory officeholders, aligns citations of amended Acts, and includes administrative changes to streamline relevant legislation. Non-compliance could lead to legal or administrative repercussions.
