Overview

The Salaries Act 1968 was enacted by the Queen’s Most Excellent Majesty, the Senate, and the House of Representatives of the Commonwealth of Australia to address the need for updating the salaries and allowances for holders of certain offices. The Act amends various specified Acts to adjust the remuneration for office holders, ensuring that their salaries and allowances are in line with contemporary standards. The policy objective of this Act is to provide fair and adequate compensation for public officials, thereby maintaining the integrity and efficiency of public service. The amendments outlined in the Act ensure that the salaries and allowances of key public officers are revised to reflect the economic conditions and the responsibilities associated with their roles.

Scope and Application

The Salaries Act 1968 is a Commonwealth statute that applies to the holders of specific offices within the public sector, specifically those listed in the First Schedule. These offices include the Auditor-General for the Commonwealth, the Acting Auditor-General for the Commonwealth, the Commonwealth Railways Commissioner, the Director-General of Posts and Telegraphs, the Chairman of the Public Service Board, members of the Public Service Board, the Public Service Arbitrator, members of the Repatriation Commission, the Commissioner of Taxation, the Second Commissioner of Taxation, and the Commissioner of Trade Practices. The Act amends the salaries and allowances payable to these officeholders by specifying new rates and allowances. The amendments are detailed in the First Schedule of the Act, which provides for specific salary adjustments and additional allowances for each office mentioned. The Act also includes provisions for the citation of the amended Acts as specified in the Second Schedule. The Act's application is nationwide, reflecting its Commonwealth status, and it extends to the amendment of specified sections of other related Acts. There are no stated exclusions or exemptions within the text of the Act itself, although the scope of application may be further defined or restricted by any subordinate instruments made under the authority of the Act.

Key Provisions

The Salaries Act 1968 primarily deals with the amendment of various acts to adjust the salaries and allowances of certain officeholders (section 1). Specifically, it alters the remuneration for the holders of several high-level positions within the Commonwealth government, including the Auditor-General, the Director-General of Posts and Telegraphs, and the Chairman of the Public Service Board, among others (section 3). These amendments are detailed in the First Schedule to the Act, where precise salary adjustments and the addition of annual allowances are specified (section 3, First Schedule). Furthermore, the Act provides for the citation of amended acts, ensuring that references to these acts remain accurate and up to date (section 4). The Act imposes obligations on various entities to ensure the updated salaries and allowances are correctly implemented. The specified offices must receive the amended remuneration as set out in the Act, and the respective departments are mandated to disburse these payments in accordance with the new rates (section 3). Additionally, the Act requires that the amended acts be cited correctly, which involves updating references to reflect the new titles and provisions (section 4). These obligations ensure that the legislative changes are effectively integrated into the existing legal framework. Breaches of the provisions in the Salaries Act 1968, such as failure to implement the updated salary and allowance rates, could potentially lead to legal consequences. However, the Act does not explicitly outline specific offences or penalties for non-compliance. The consequences of non-compliance would likely depend on the individual circumstances and the relevant provisions of the amended acts. It is essential for the entities governed by this Act to adhere to the specified remuneration rates to avoid any legal repercussions that might arise from non-compliance with the amended acts.
