Scope and Application

The Safety, Rehabilitation and Compensation (Licence Eligibility—Toll Transport Pty Ltd) Declaration 2022 applies to Toll Transport Pty Ltd, a corporation identified as carrying on business in competition with a Commonwealth authority or another corporation that was formerly a Commonwealth authority. The declaration, made under section 100 of the Safety, Rehabilitation and Compensation Act 1988, aims to make Toll Transport eligible to be granted a licence under Part VIII of the Act. The geographic and jurisdictional reach of this legislation is specific to entities carrying on business in competition with Commonwealth authorities within Australia. There are no stated exclusions or exemptions within the primary text of this legislation; however, the application and scope may be further defined or restricted by subordinate instruments. This instrument is repealed 54 months after its commencement, as per its own provisions, although it may be subject to modifications or amendments by other laws not reflected in this compilation.

Key Provisions

The Safety, Rehabilitation and Compensation (Licence Eligibility—Toll Transport Pty Ltd) Declaration 2022 (section 5) is made under the authority of section 100 of the Safety, Rehabilitation and Compensation Act 1988 (section 3). This legislation declares that Toll Transport Pty Ltd is eligible for a licence under Part VIII of the Act, which concerns safety, rehabilitation, and compensation for employees. Toll Transport Pty Ltd, with ABN 31 006 604 191 and ACN 006 604 191, is identified as a corporation that operates in competition with a Commonwealth authority or a former Commonwealth authority (section 4). The declaration is effective until it is repealed, which will occur 54 months after the commencement of this instrument (section 6). The Act imposes several obligations and requirements on Toll Transport Pty Ltd and its employees. Firstly, it mandates that Toll Transport Pty Ltd must apply for and obtain a licence under Part VIII of the Act. This licence is essential for the company to legally operate and manage employee safety, rehabilitation, and compensation schemes. The declaration’s provisions ensure that Toll Transport Pty Ltd adheres to the standards and regulations set forth in the Act, thereby safeguarding the welfare of its employees. Additionally, employees of Toll Transport Pty Ltd are entitled to the protections and benefits outlined in the Act, including access to rehabilitation services, compensation for work-related injuries, and a safe working environment. Failure to comply with the requirements of the Safety, Rehabilitation and Compensation (Licence Eligibility—Toll Transport Pty Ltd) Declaration 2022 may result in various civil and criminal consequences. The Act may impose penalties for non-compliance, although the specific penalties are not detailed within the declaration itself. Generally, under the Safety, Rehabilitation and Compensation Act 1988, penalties for breaches can include fines, imprisonment, or both, depending on the severity of the offence. The maximum penalties would be determined by the specific provisions of the Act that apply to the nature of the breach. Compliance with the Act is crucial to avoid legal repercussions and ensure the protection of employees’ rights.
