Overview

The Safety, Rehabilitation and Compensation (Licence Eligibility—Healthscope Operations Pty Ltd) Declaration 2019, enacted in 2019, addresses the need to extend the application of the Safety, Rehabilitation and Compensation Act 1988 to employees of Healthscope Operations Pty Ltd, a corporation that competes with a Commonwealth authority or a former Commonwealth authority. This legislative instrument was made under section 100 of the Act, reflecting the policy objective to ensure that the regulatory framework for safety, rehabilitation, and compensation is uniformly applied across relevant entities. The declaration was issued by the relevant authority, satisfied that it would be desirable for the Act to apply to Healthscope Operations, thereby granting the corporation eligibility to be licensed under Part VIII of the Act. The instrument is set to be repealed after a 90-month period from its commencement date, as stipulated within the legislation.

Scope and Application

The Safety, Rehabilitation and Compensation (Licence Eligibility—Healthscope Operations Pty Ltd) Declaration 2019 is an instrument made under section 100 of the Safety, Rehabilitation and Compensation Act 1988. This declaration specifically identifies Healthscope Operations Pty Ltd as eligible to be granted a licence under Part VIII of the Act, thereby subjecting its employees to the provisions of the Act. This eligibility is contingent on the entity being involved in competition with a Commonwealth authority or another corporation formerly associated with the Commonwealth. The declaration is effective as of 6 April 2019, and it has undergone several amendments, with the latest being F2025L00115 which came into effect on 13 February 2025. This legislative instrument is repealed ninety months after its commencement, thereby limiting its duration and application. The Act applies to the employees of Healthscope Operations Pty Ltd, ensuring that they are covered by the safety, rehabilitation, and compensation provisions of the legislation within the Commonwealth jurisdiction.

Key Provisions

The Safety, Rehabilitation and Compensation (Licence Eligibility—Healthscope Operations Pty Ltd) Declaration 2019, under section 100 of the Safety, Rehabilitation and Compensation Act 1988, declares that Healthscope Operations Pty Ltd is eligible for a licence under Part VIII of the Act (section 5). This legislative instrument is effective from 6 April 2019 and will be repealed 90 months after its commencement (section 6). The instrument includes a definition clause that specifies "Healthscope Operations" refers to Healthscope Operations Pty Ltd, with ABN 85 006 405 152 and ACN 006 405 152 (section 4). The Act imposes specific obligations on Healthscope Operations Pty Ltd to comply with safety, rehabilitation, and compensation regulations. As a licensed entity under Part VIII of the Act, Healthscope Operations must adhere to the statutory requirements and standards set forth in the legislation. This includes implementing necessary safety measures, rehabilitating injured employees, and ensuring compliance with compensation obligations for workplace injuries and illnesses. The obligations extend to maintaining records, reporting incidents, and cooperating with any investigations or audits conducted by relevant authorities. Failure to comply with the requirements of the Safety, Rehabilitation and Compensation Act 1988 can result in civil or criminal penalties. The specific consequences for breach depend on the nature and severity of the violation. Civil penalties may include fines, while criminal penalties could involve imprisonment. The exact penalties are determined by the courts based on the circumstances of each case, and the Act does not specify maximum penalties within the Declaration itself. However, the broader Act outlines various penalties for different breaches, which could apply to Healthscope Operations Pty Ltd under this Declaration.
