Safety, Rehabilitation and Compensation Act 1988

Safety, Rehabilitation and Compensation Amendment Regulations 2005 (No. 1)

The Safety, Rehabilitation and Compensation Act 1988 (the Act) establishes the Commonwealth workers compensation and rehabilitation scheme.

Section 122 of the Act provides that the Governor-General may make regulations, not inconsistent with the Act, prescribing all matters required or permitted by the Act to be prescribed for carrying out or giving effect to the Act.

Subsection 28(1) of the Act provides that Comcare may prepare a written document called the “Guide to the Assessment of the Degree of Permanent Impairment” (the Guide), setting out criteria by which the degree of the permanent impairment and non-economic loss suffered by an employee as a result of an injury is to be determined.

Subsection 28(8) of the SRC Act provides that, upon payment of a prescribed fee, Comcare must make the Guide available to persons requesting it.  Regulation 18 of the Safety, Rehabilitation and Compensation Regulations 2002 (the Principal Regulations) currently prescribes a $10 fee for the purchase of the Guide.

The Regulations increase the prescribed fee for the purchase of the Guide to $30.

The amended charge reflects current production costs, which have increased in the 17 years since the fee was last prescribed.  The new fee coincides with the release of a new version of the Guide by Comcare and reflects the greater size and coverage of the revised Guide.

Details of the Regulations are set out in the Attachment.

The Regulations commence on the day after they are registered.  The Regulations are a legislative instrument for the purpose of the Legislative Instruments Act 2003.

Overview

The Safety, Rehabilitation and Compensation Amendment Regulations 2005 (No. 1) were introduced to address the rising production costs associated with the "Guide to the Assessment of the Degree of Permanent Impairment," a document prepared by Comcare under the Safety, Rehabilitation and Compensation Act 1988. Enacted by the Governor-General under section 122 of the Act, these regulations aim to align the fee for the Guide with its current production costs, which have increased substantially over the past 17 years. This adjustment, which raises the fee from $10 to $30, coincides with the release of a new, more comprehensive version of the Guide. The policy objective here is to ensure that the fee reflects the true cost of producing the Guide, thereby maintaining its quality and usefulness for those requesting it. These Regulations, issued by the Minister for Employment and Workplace Relations, are intended to facilitate smoother operation of the Commonwealth workers' compensation and rehabilitation scheme.

Scope and Application

The Safety, Rehabilitation and Compensation Amendment Regulations 2005 (No. 1) relate to the Safety, Rehabilitation and Compensation Act 1988, which establishes the Commonwealth workers' compensation and rehabilitation scheme. The Regulations are designed to update the prescribed fee for the purchase of the "Guide to the Assessment of the Degree of Permanent Impairment", which is prepared by Comcare and provides criteria for determining the degree of permanent impairment and non-economic loss for injured employees. This legislative instrument applies to all persons or entities who seek to purchase the Guide, thereby directly affecting employees and employers within the scope of the Commonwealth workers' compensation scheme. The Regulations have a national reach as they pertain to the Commonwealth's legislative jurisdiction. The Regulations do not exclude any specific entities or industries but are limited to the context of the workers' compensation and rehabilitation scheme. Any changes or extensions to the application of these Regulations may be made through further subordinate instruments, though no such provisions are mentioned in the provided text.

Key Provisions

The Safety, Rehabilitation and Compensation Amendment Regulations 2005 (No. 1) introduce key modifications to the existing framework under the Safety, Rehabilitation and Compensation Act 1988 (SRC Act). Specifically, these Regulations amend the fee structure for the "Guide to the Assessment of the Degree of Permanent Impairment" (the Guide) as outlined in Regulation 18 of the Safety, Rehabilitation and Compensation Regulations 2002 (Principal Regulations). According to Regulation 3 of the new Regulations, the fee for the Guide is increased from $10 to $30. This change is intended to reflect the increased production costs over the past 17 years and aligns with the release of a revised and more comprehensive version of the Guide by Comcare. The obligations under the SRC Act include the preparation of the Guide by Comcare, as mandated by section 28(1). This Guide is essential for determining the degree of permanent impairment and non-economic loss suffered by an employee as a result of an injury. Comcare is required to make the Guide available to persons upon payment of the prescribed fee, as stipulated in section 28(8) of the SRC Act. The Regulations, by adjusting the fee to $30, ensure that these services remain accessible while accounting for updated costs and enhanced content. Failure to comply with the provisions of the SRC Act and the amended Regulations could lead to legal consequences. While the specific Offences and penalties are not detailed in the provided text, breaches of regulations governing workers’ compensation and rehabilitation could generally result in civil or criminal penalties, depending on the nature and severity of the breach. These could include fines or other sanctions as prescribed by relevant legislation. The exact penalties would be determined based on the specific circumstances and the applicable laws in force at the time of the breach.
