Overview

Statutory Rules 1970 No. 184, made under the Defence Act 1903-1970, was enacted to amend the Royal Military College Regulations, specifically concerning cadet pay, allowances, and payments. The objective was to provide cadets with a fair credit system for their earnings and to ensure they are compensated appropriately when not provided with meals during duty hours. The regulations were made by the Governor-General in accordance with the advice of the Federal Executive Council. These amendments aimed to address gaps in financial support and ensure cadets are rewarded for their service in alignment with their duties and responsibilities. The changes to the regulations reflect an intention to enhance the financial benefits for cadets, ensuring they are properly compensated for their time and efforts.

Scope and Application

The Regulations under the Defence Act 1903-1970, specifically amending the Royal Military College Regulations, apply to cadets enrolled at the Royal Military College, Duntroon. These amendments primarily focus on financial aspects such as pay, allowances, and payments to cadets, as well as the payment of accumulated credits upon graduation or discharge. The regulations impact the financial transactions and entitlements of cadets, ensuring that their accounts are accurately credited or debited based on specific circumstances, such as missed meals due to duty or the accumulation of credits from pay. The scope of these regulations is limited to the Royal Military College, Duntroon, and the cadets enrolled there, with no stated exclusions or exemptions. The amendments extend the application of the financial provisions for cadets and ensure that the financial aspects of their education and training are clearly defined and regulated. Any further application or interpretation of these regulations may be detailed in subordinate instruments.

Key Provisions

The Statutory Rules 1970 No. 239, made under the Defence Act 1903-1970, contain amendments to the Royal Military College Regulations, specifically affecting cadet pay and allowances. Regulation 46(3) is altered to require the retention of thirty cents per day as an accumulating credit in the cadet's account from their credited pay. Regulation 47 is expanded to credit cadets with specific meal allowances if they are not provided a meal, not given a meal voucher, and not credited with a travel allowance when travelling on duty. Regulation 50 is amended to include the accumulating credit in the payments to cadets, subject to special circumstances. Regulation 58(1) is revised to ensure the accumulated credit is paid to the cadet a month before graduation or upon discharge, while any other credit is paid at graduation or discharge. These regulations impose clear obligations on the Commonwealth and the cadets. The Commonwealth must retain an accumulating credit of thirty cents per day from the cadet's pay and ensure that meal allowances are credited if certain conditions are met. Cadets must be aware of their entitlements and the conditions under which they are granted, such as when they are not provided a meal during duty hours. Furthermore, the Commonwealth is required to ensure that cadets are paid their accumulated credits before graduation or discharge, and any other credits upon graduation or discharge. The legislation does not explicitly outline specific offences, penalties, or consequences for breaches within the text provided. However, any failure by the Commonwealth to adhere to these provisions could potentially lead to claims by cadets for unpaid credits or allowances, which might be pursued through administrative or judicial processes. The absence of explicit penalties in the text suggests that the focus is on the proper administration of financial entitlements rather than punitive measures for non-compliance.
