Overview

The Statutory Rules of 1916, No. 213, establish regulations and instructions for the Royal Australian Naval Reserve under the Naval Defence Act 1910–1912. Enacted by the Governor-General in Council, these regulations aim to address the need for updated policies within the Naval Reserve, particularly concerning retirement ages and allowances for attendance at funerals and church parades. This legislative instrument is intended to refine the administration and operational standards of the Naval Reserve to ensure efficiency and fairness in service provisions. The policy objective is to provide clear guidelines for the age at which officers must retire and to regulate the conditions under which attendance at specific events may be compensated, thereby enhancing the operational structure of the Naval Reserve.

Scope and Application

The Regulations and Instructions for the Royal Australian Naval Reserve (M), established under the Naval Defence Act 1910–1912, are applicable to all officers and members of the Royal Australian Naval Reserve, including Lieutenants, Sub-Lieutenants, and Midshipmen, as well as other personnel involved in the operations of the reserve. These regulations govern aspects such as the age for retirement of officers, with specific ages prescribed for different ranks, and also address the matter of pay and allowances, particularly clarifying the conditions under which attendance at funerals or church parades counts towards pay and retainer. The regulations have a national jurisdictional reach, as they are issued by the Governor-General in Council under the authority of the Commonwealth of Australia. Notably, these regulations provide explicit instructions and amendments, such as altering the age for retirement and updating the rules on pay and allowances for specific duties, ensuring the reserve operates smoothly and efficiently within its defined parameters.

Key Provisions

The Regulations and Instructions for the Royal Australian Naval Reserve (M) introduce specific provisions regarding the age for retirement of officers within the Reserve (Section 1). According to Regulation 13, the age for retirement has been adjusted for different ranks: Lieutenants must retire at 52 years of age, Sub-Lieutenants at 40 years of age, and Midshipmen at 30 years of age. These provisions clarify the age at which officers in these ranks are required to retire from the Reserve, ensuring a structured transition within the service. The Regulations and Instructions also address pay and allowances for members of the Royal Australian Naval Reserve (Section 6). Regulation 76 revises the conditions under which attendance at funerals or church parades counts for pay and retainer. Specifically, attendance at such events does not count for pay and retainer unless a member of the Band is required by the District Naval Officer to attend an approved Naval funeral, in which case they are entitled to pay and retainer for a whole day or a proportionate amount for a half-day parade. This amendment aims to ensure that members who participate in essential ceremonial duties receive appropriate compensation. Parties or entities governed by these Regulations and Instructions are subject to several obligations and requirements. Officers must adhere to the specified retirement ages outlined in Regulation 13. This means that upon reaching the designated retirement age, they must retire from active service in the Reserve. Members of the Band, on the other hand, must comply with the requirements for attendance at funerals and church parades as stipulated in Regulation 76. This includes ensuring that they are required by the District Naval Officer to attend approved Naval funerals to be eligible for pay and retainer. Breaches of these Regulations and Instructions may result in various civil or criminal consequences. While specific offences and penalties are not detailed within the text provided, non-compliance with the retirement age provisions or attendance requirements could lead to disciplinary actions within the Reserve. Additionally, failure to adhere to these regulations might impact a member's eligibility for pay and retainer, potentially resulting in financial repercussions. The precise nature of the penalties would depend on the severity and context of the breach, as well as any applicable internal disciplinary procedures within the Reserve.
