1 Name of Regulations [see Note 1]

  These Regulations are the Road Transport Charges (Australian Capital Territory) Regulations 1995.

2 Interpretation

  In these Regulations, the Act means the Road Transport Charges (Australian Capital Territory) Act 1993.

2AA Alteration of amounts specified in the Schedule to the Act

  For section 4 of the Act, the annual registration charges specified under headings 1, 2, 3 and 4 of Part 2 of the Schedule to the Act are altered so as to be as set out in Schedule 1 to these Regulations.

2A Vehicles declared not to be special purpose vehicles

  For paragraph (a) of the definition of special purpose vehicle in Part 1 of the Schedule to the Act, each of the following vehicles is declared not to be a special purpose vehicle:

 (a) a caravan;

 (b) a mobile home;

 (c) a mobile library;

 (d) a mobile workshop;

 (e) a mobile laboratory;

 (f) a mobile billboard.

2B Vehicles declared to be special purpose vehicles

  For paragraph (b) of the definition of special purpose vehicle in Part 1 of the Schedule to the Act, each of the following vehicles is declared to be a special purpose vehicle:

 (a) a forklift;

 (b) a straddle carrier;

 (c) a mobile cherry picker;

 (d) a mobile crane.

3 What are the axle load limits for special purpose vehicles?

  For the purposes of the definitions of special purpose vehicle (type o) and special purpose vehicle (type t) in Part 1 of the Schedule to the Act, the load limit for an axle or axle group specified in column 2 of Part 1 of Schedule 2 to these Regulations is specified in column 3 of Part 1.

4 How is N ascertained for the purposes of Part 3 of the Schedule to the Act?

 (1) For the purposes of the formula set out in Part 3 of the Schedule to the Act, the number N, in relation to a vehicle or a combination of vehicles that includes one or more trailers, is the sum of the equivalent standard axles for each of the rows of tyres across the trailer or trailers.

 (2) For the purposes of subregulation (1):

 (a) the number of equivalent standard axles for a row of 8 tyres across a trailer is determined by reference to Table A in Part 2 of Schedule 2; and

 (b) the number of equivalent standard axles for a row of 4 tyres across a trailer is determined by reference to Table B in Part 2 of Schedule 2.

 (3) For the purposes of subregulation (2) and Part 2 of Schedule 2, the average load (in tonnes) for a row of tyres across a trailer is worked out using the following formula:

C

B

  where:

C is the loaded mass  (in tonnes) of the trailer.

B is the number of rows of tyres across the trailer.

Note   Under section 4 of the Act, the regulations may alter the amounts specified in the Schedule to the Act in relation to a year, but any alteration in relation to a year must not increase or decrease the amounts applicable to the previous year by more than 5%. The alterations made by regulation 2AA and this Schedule increase the amounts specified in Part 2 of the Schedule to the Act by 3.3%, taken to the nearest dollar.

Overview

The Road Transport Charges (Australian Capital Territory) Regulations 1995 were enacted to provide detailed implementation of the Road Transport Charges (Australian Capital Territory) Act 1993, addressing the need for precise regulations governing road transport charges in the Australian Capital Territory. These regulations, prepared by the Office of Legislative Drafting, Attorney-General’s Department, Canberra, were made under the authority of the Road Transport Charges (Australian Capital Territory) Act 1993, which itself was enacted by the Parliament of the Australian Capital Territory. The objective of these regulations is to set out the specific annual registration charges, axle load limits for special purpose vehicles, and the methodology for ascertaining axle loads and charges for trailers and buses, thereby ensuring a structured and equitable approach to road transport charges in the Territory.

Scope and Application

The Road Transport Charges (Australian Capital Territory) Regulations 1995, which are statutory rules made under the Road Transport Changes (Australian Capital Territory) Act 1993, apply to vehicles and their registration within the Australian Capital Territory. These regulations are designed to set out specific details such as annual registration charges, axle load limits for special purpose vehicles, and the method of determining axle loads for vehicles. The regulations apply to various types of vehicles, including trucks, buses, and special purpose vehicles, and establish specific registration charges for these vehicles based on their type and axle configuration. The regulations also specify the axle load limits for different types of axles and axle groups, as well as the methodology for determining the equivalent standard axles for rows of tyres across trailers. Notably, certain vehicles are excluded from being classified as special purpose vehicles, such as caravans and mobile homes, while others like forklifts and mobile cranes are included in this category. The application of these regulations is limited to the Australian Capital Territory, and any changes to the regulations are subject to the constraints outlined in the principal Act, such as the limitation on the percentage increase or decrease in charges from the previous year.

Key Provisions

The Road Transport Charges (Australian Capital Territory) Regulations 1995, made under the Road Transport Changes (Australian Capital Territory) Act 1993, include several key provisions. Regulation 2AA alters the annual registration charges specified in the Act’s Schedule, and these changes are detailed in Schedule 1. Regulation 2A identifies vehicles that are not considered special purpose vehicles, such as caravans and mobile homes, while Regulation 2B lists vehicles that are deemed special purpose vehicles, including forklifts and mobile cranes. Regulation 3 specifies the axle load limits for special purpose vehicles, with detailed limits provided in Schedule 2. Regulation 4 explains how the number 'N' is ascertained for the purposes of calculating charges under the Act, with specific tables provided for trailers with rows of 8 and 4 tyres, as outlined in Schedule 2. The Regulations impose several obligations on parties and entities. Vehicle owners must ensure their vehicles are correctly classified as either special purpose vehicles or not, as defined in Regulations 2A and 2B. Owners must also adhere to the specified axle load limits for special purpose vehicles as outlined in Regulation 3 and Schedule 2. Furthermore, the Act and Regulations require vehicle owners to calculate the annual registration charge accurately, using the formula and tables provided in Regulation 4 and Schedule 2. Non-compliance with these requirements can result in penalties or other legal consequences. The Act and Regulations do not explicitly detail offences, penalties, or consequences for breach within the provided text. However, under the general principles of administrative law and the provisions of the Road Transport Charges (Australian Capital Territory) Act 1993, breaches of these Regulations could potentially lead to fines, penalties, or other enforcement actions as deemed appropriate by the relevant authorities. The exact penalties would depend on the specific nature and severity of the breach, as well as any relevant statutory provisions.
