Overview
The Telecommunications Act 1997 was enacted to regulate the telecommunications industry in Australia, ensuring fair competition, consumer protection, and the efficient use of the radio spectrum. The Act was introduced to address the growing need for comprehensive regulation in a rapidly evolving telecommunications sector. The Australian Parliament enacted the Telecommunications Act 1997 to provide a robust framework for the regulation of telecommunications services and infrastructure. One of the policy objectives of the Act is to promote competition and consumer protection within the telecommunications market, ensuring that service providers operate in a fair and transparent manner. This includes provisions for the regulation of designated network operators, such as the revocation of a nominated carrier declaration when certain conditions are no longer met. In this context, the Australian Communications and Media Authority (ACMA) has the authority to revoke a nominated carrier declaration if the entity no longer meets the necessary criteria, as demonstrated in the case of WorldVu Australia Pty Ltd.
Scope and Application
The Telecommunications Act 1997 governs various aspects of telecommunications in Australia, and under its provisions, the Australian Communications and Media Authority (ACMA) has the power to designate nominated carriers, which are companies authorised to provide specific telecommunications services. In this instance, the ACMA has revoked the nominated carrier declaration of WorldVu Australia Pty Ltd, a company that was previously authorised to supply carriage services to the public using network units owned by Australian AntennaCo Pty Ltd. This revocation is effective from 1 June 2026 and follows a determination by the ACMA that, if WorldVu Australia were to apply for such a declaration today, it would be refused. The Telecommunications Act 1997 applies to telecommunications service providers and their operations within Australia, and the ACMA’s authority to grant and revoke nominated carrier declarations is a means to regulate and ensure compliance within this sector. The act’s provisions extend to all telecommunications entities operating in Australia, thereby impacting the industry’s landscape and the services provided to consumers.
Key Provisions
The primary operative section of this Gazette Notice is subsection 83(1) of the Telecommunications Act 1997, which empowers the Australian Communications and Media Authority (ACMA) to revoke a nominated carrier declaration. This particular revocation, detailed in Gazette Notice C2026G00451, concerns WorldVu Australia Pty Ltd (ACN 628 318 963) and its previously granted nominated carrier declaration (NCD 206) for network units owned by Australian AntennaCo Pty Ltd (ACN 688 990 221). This revocation, signed by Dominic Byrne, a delegate of the ACMA, is effective from 1 June 2026, and is based on the authority granted by paragraph 83(1) of the Act.
The Act imposes specific obligations on entities like WorldVu Australia Pty Ltd to maintain the standards and compliance required to hold a nominated carrier declaration. These obligations include ensuring that the services provided meet the necessary regulatory standards and that the entity remains eligible for the declaration. Failure to meet these standards can result in the ACMA refusing to renew or even revoking the declaration, as evidenced in this Gazette Notice. The revocation process reflects the ACMA's commitment to ensuring that only entities that meet the required standards can operate as nominated carriers.
The Telecommunications Act 1997 also sets out the consequences for breaches of its provisions. In this case, the revocation of the nominated carrier declaration is a direct consequence of WorldVu Australia Pty Ltd's failure to meet the required standards for the declaration. The Act does not specify particular criminal or civil penalties for such revocations, but it does provide a clear framework for the ACMA to take action against entities that do not comply with its requirements. This ensures that the telecommunications sector remains regulated and that public interests are protected.
