REVOCATION OF NOMINATED CARRIER DECLARATION – Telstra Limited (NCD number 180)

I, Vivian Tee, delegate of the Australian Communications and Media Authority (‘the ACMA’), acting under paragraph 83(2)(a) of the Telecommunications Act 1997 and being satisfied that:

1.    Telstra Limited (ACN 086 174 781) was granted a nominated carrier declaration under subsection 81(1) of the Telecommunications Act 1997 on 14 December 2022 in relation to network units owned by Atlas Iron Pty Ltd (ACN 110 396 168) (the ‘Nominated Carrier Declaration’), a copy of which is included at Appendix A; and

1.    Atlas Iron Pty Ltd, as owner of the network units, has given the ACMA a written notice stating it does not consent to the continued operation of the Nominated Carrier Declaration;

hereby revoke the Nominated Carrier Declaration under subsection 83(2) of the Telecommunications Act 1997.

The revocation of the Nominated Carrier Declaration takes effect on 18 November 2024.

Subsection 81(1)

NOMINATED CARRIER DECLARATION – TELSTRA LIMITED

I, Dominic Byrne, delegate of the Australian Communications and Media Authority (ACMA), being satisfied that:

(a) if this declaration were made, Telstra Limited ACN 086 174 781 (the applicant) would be in a position to comply with all of the obligations imposed on the applicant in the applicant’s capacity as the nominated carrier in relation to the network unit described below; and

(b) the making of this declaration will not impede the efficient administration of:

(i) the Telecommunications Act 1997;

(ii) the Telecommunications (Consumer Protection and Service Standards) Act 1999 and regulations under that Act;

declare that Telstra Limited ACN 086 174 781, holder of carrier licence number 582, is the nominated carrier in relation to network units owned by Atlas Iron Pty Ltd ACN 110 396 168, being the microwave radio link connecting the Telstra demarcation point located at Telstra’s Marble Bar Radio Terminal in Western Australia (ACMA Site ID 36403, location -21.1731, 119.75083) to Sanjiv Ridge Mine Tower (ACMA Site ID 10019235, location -21.4439, 119.67379) and onto the Atlas Iron communications equipment building at the Sanjiv Ridge Mine Camp (ACMA Site ID 10019234, location -21.3801, 119.69719) for the purposes of:

1.      Carrying communications to or from Telstra’s public mobile telecommunications network; and
2.      Providing 4G mobile services to Sanjiv Ridge Camp.

Note: the geographic coordinates above are referenced as latitude and longitude using the GDA94 geodetic system.
