I, Dominic Byrne, delegate of the Australian Communications and Media Authority (ACMA), being satisfied that:

Overview

The Telecommunications Act 1997, enacted by the Australian Parliament, was introduced to establish a regulatory framework for the telecommunications industry in Australia, aiming to ensure efficient and effective administration of telecommunications services, protect consumers, and maintain competition within the industry. The Act addresses gaps in the regulation of telecommunications services, providing a comprehensive legal basis for the oversight of the sector, including the establishment of the Australian Communications and Media Authority (ACMA). In the case of Telstra Corporation Limited, the Act facilitates the designation of nominated carriers for specific network units, as demonstrated in the revocation of Telstra’s nominated carrier declaration for certain network units owned by QGC Pty Ltd, reflecting the ACMA’s commitment to ensuring compliance with telecommunications obligations while maintaining efficient administration of related legislation.

Scope and Application

The Telecommunications Act 1997 governs telecommunications in Australia, applying to persons and entities involved in telecommunications activities, including carriers, licensees, and service providers, across the nation. This legislation establishes the framework for the regulation of telecommunications services, including the issuance of licences, imposition of obligations, and the enforcement of standards. The Act is administered by the Australian Communications and Media Authority (ACMA), which is responsible for ensuring compliance with the Act's provisions. Under the Act, Telstra Corporation Limited was granted a nominated carrier declaration concerning specific network units owned by QGC Pty Ltd, enabling Telstra to act as the nominated carrier for those units. However, the revocation of this declaration by a delegate of the ACMA, Dominic Byrne, reflects Telstra's decision to no longer accept responsibility for these network units. The revocation is made under the authority granted by the Act and is effective as of the specified date, with the former declaration nullified. The Act's broad jurisdictional reach encompasses all telecommunications activities within Australia, with its provisions being applicable nationally.

Key Provisions

The main operative sections of the document include subsection 81(1) and paragraph 83(2)(b) of the Telecommunications Act 1997. Subsection 81(1) pertains to the granting of a nominated carrier declaration, which was issued to Telstra Corporation Limited for the network units owned by QGC Pty Ltd. Paragraph 83(2)(b) provides the authority to revoke such a declaration. The revocation of the Nominated Carrier Declaration, as stated in paragraph 83(2)(b), is based on the fact that Telstra Corporation Limited has declared that it does not accept responsibility for the network units as per the Telecommunications Act 1997. The obligations imposed by the Act on the parties involved include the necessity for Telstra Corporation Limited to comply with all obligations as a nominated carrier in relation to the specified network units. This includes ensuring that the declaration does not impede the efficient administration of the Telecommunications Act 1997, the Telecommunications (Consumer Protection and Service Standards) Act 1999, and any regulations under that Act. Additionally, Telstra must provide written notice to the Australian Communications and Media Authority (ACMA) if it no longer wishes to accept responsibility for the network units. The document outlines specific consequences for breaches of the Act. Firstly, the revocation of the Nominated Carrier Declaration is a direct consequence of Telstra Corporation Limited's written notice stating that it does not accept responsibility for the network units. This revocation means that Telstra is no longer recognised as the nominated carrier for the specified network units, and therefore, no longer has the obligations and responsibilities associated with that role. The document does not explicitly detail other potential offences, penalties, or consequences for breach, but it can be inferred that failure to comply with the Act could result in further regulatory actions by the ACMA.
