REVOCATION OF NOMINATED CARRIER DECLARATION – Satellite and Wireless Pty Ltd (NCD number 93)

I, Dominic Byrne, delegate of the Australian Communications and Media Authority (‘the ACMA’), acting under paragraph 83(1) of the Telecommunications Act 1997 and being satisfied that:

1.    Satellite and Wireless Pty Ltd (ACN 103 881 303) was granted a nominated carrier declaration under subsection 81(1) of the Telecommunications Act 1997 on 15 August 2007 in relation to network units owned by IP Systems Pty Ltd (the ‘Nominated Carrier Declaration’), a copy of which is included at Appendix A; and

1.    If Satellite and Wireless Pty Ltd was to apply for the Nominated Carrier Declaration today, the ACMA would refuse to make the declaration;

hereby revoke the Nominated Carrier Declaration under subsection 83(1) of the Telecommunications Act 1997.

The revocation of the Nominated Carrier Declaration takes effect on 1 September 2024.

Subsection 81(1)

NOMINATED CARRIER DECLARATION

I, Giles Tanner, delegate of the Australian Communications and Media Authority acting under subsection 81(1) of the Telecommunications Act 1997 being satisfied that:

1.    if Satellite and Wireless Pty Ltd, ACN 103 881 303 is declared to be the nominated carrier in relation to the network unit or units, it would be in a position to comply with all of the obligations imposed on the carrier in its capacity as the nominated carrier in relation to the unit or units; and
2.    the making of the declaration will not impede the efficient administration of the Telecommunications Act 1997 and the Telecommunications (Consumer Protection and Service Standards) Act 1999;

declare that Satellite and Wireless Pty Ltd is the nominated carrier for multiple line links located in the Aurora Estate at Epping North, Victoria and the Valley Lake Estate at Niddrie, Victoria and a designated radiocommunications facility between 97 Forest Street Kalgoorlie and 68 Burt Street Boulder, West Australia owned by IP Systems Pty Ltd, ACN 065 092 962.
