Overview

The Telecommunications Act 1997 was enacted to address the need for regulation and oversight of telecommunications services in Australia, aiming to ensure the efficient administration of telecommunications laws and the protection of consumers. This Act provides the legislative framework for the Australian Communications and Media Authority (ACMA) to manage and regulate telecommunications services, including the licensing and oversight of carriers. The policy objective of the Act is to facilitate the provision of telecommunications services while safeguarding consumer rights and maintaining efficient administration. The authority to revoke nominated carrier declarations, as evidenced in the revocation of PIPE Networks Pty Ltd's declaration, underscores the ACMA's role in enforcing compliance with telecommunications obligations and ensuring the integrity of the telecommunications network.

Scope and Application

The Telecommunications Act 1997, as demonstrated in the revocation of the nominated carrier declaration for PIPE Networks Pty Ltd, governs telecommunications carriers and their operations within Australia. The Act applies to entities such as PIPE Networks Pty Ltd, which was granted a nominated carrier declaration to operate as a nominated carrier for TPG Internet Pty Ltd's network units. This declaration allows the entity to be recognised as the nominated carrier for specified telecommunications networks, enabling it to comply with the obligations under the Act and related service standards. The jurisdictional reach of the Act is national, as the nominated carrier declaration pertains to networks located around Australia. The revocation process outlined in the Act allows the Australian Communications and Media Authority to rescind a carrier's declaration if the nominated carrier no longer accepts responsibility for the specified network units, as demonstrated in the revocation of PIPE Networks Pty Ltd's declaration on 29 July 2025. The Act also provides for the potential extension or restriction of its application through subordinate instruments, ensuring its provisions can adapt to changes in telecommunications technology and industry practices.

Key Provisions

The main operative sections of the revocation document, as per the Telecommunications Act 1997 (subsection 83(2)), involve the formal revocation of the nominated carrier declaration that was previously granted to PIPE Networks Pty Ltd (ACN 099 104 122). This revocation is due to the company's written notice stating it does not accept responsibility for the network units under the Act. The revocation is effective from 29 July 2025 and was signed by Vivian Tee, a delegate of the Australian Communications and Media Authority (ACMA), on 10 October 2025. The original declaration, dated 28 February 2018, was made by Silvia Superina, another ACMA delegate, and identified PIPE Networks Pty Ltd as the nominated carrier for TPG Internet Pty Ltd's cellular and microwave radiocommunications networks. The Telecommunications Act 1997 imposes various obligations on entities granted a nominated carrier declaration. In this instance, PIPE Networks Pty Ltd was required to ensure compliance with all obligations related to being the nominated carrier, including the efficient administration of the Telecommunications Act 1997 and the Telecommunications (Consumer Protection and Service Standards) Act 1999. These obligations included providing reliable and efficient telecommunications services to customers and maintaining the necessary infrastructure and standards. However, by notifying the ACMA of its decision to no longer accept responsibility for the network units, PIPE Networks Pty Ltd failed to uphold these obligations. Failure to meet the obligations outlined in the Telecommunications Act 1997 can lead to various consequences, including revocation of the nominated carrier declaration, as seen in this case. This revocation means that PIPE Networks Pty Ltd is no longer recognised as the nominated carrier for TPG Internet Pty Ltd's network units, effective from the specified date. The revocation can potentially lead to disruptions in telecommunications services provided by TPG Internet Pty Ltd and may also have broader implications for the telecommunications market in Australia. The consequences for such breaches are intended to ensure that nominated carriers maintain the required standards and responsibilities to protect consumers and uphold the efficient administration of telecommunications legislation.
