Overview

The Telecommunications Act 1997, enacted by the Australian Parliament, addresses the regulation of telecommunications services and infrastructure within Australia. This legislation aims to ensure that telecommunications services are provided efficiently and effectively while protecting consumers and maintaining industry standards. The Act provides a comprehensive framework for the licensing, regulation, and oversight of telecommunications carriers and their services, including the designation of nominated carriers responsible for specific network units. The Australian Communications and Media Authority (ACMA), as the enforcing body, plays a critical role in administering the Act, ensuring compliance, and addressing any gaps or issues that arise within the telecommunications sector. The revocation of a nominated carrier declaration, as evidenced by the decision to revoke the declaration for PIPE Networks Pty Ltd, reflects the ACMA's commitment to maintaining the integrity and efficiency of the telecommunications infrastructure in Australia.

Scope and Application

The Telecommunications Act 1997 provides a framework for the regulation of telecommunications in Australia, including the designation and oversight of nominated carriers responsible for specific telecommunications network units. Pursuant to the Act, the Australian Communications and Media Authority (ACMA) has the authority to grant a nominated carrier declaration to an entity, such as PIPE Networks Pty Ltd, which in this case, was granted on 6 June 2017 for hybrid fibre optic and coaxial broadband cable networks owned by TransAct Victoria Communications Pty Ltd. This declaration applied to network units located in the regional cities of Mildura, Ballarat, and Geelong. The nominated carrier is responsible for ensuring compliance with all relevant obligations under the Act. However, if the nominated carrier, such as PIPE Networks Pty Ltd, withdraws its acceptance of responsibility, the ACMA has the power under subsection 83(2) of the Act to revoke the declaration, which occurred in this instance, effective from 29 July 2025. The revocation is based on the written notice from PIPE Networks Pty Ltd stating its decision not to accept responsibility for the specified network units. The Act applies nationally across Australia, and while it primarily governs entities involved in telecommunications, the specific impact and application of the Act can be extended or modified through subordinate instruments and regulations.

Key Provisions

The primary operative sections of the document, specifically subsection 81(1) and paragraph 83(2)(b) of the Telecommunications Act 1997, pertain to the granting and revocation of a nominated carrier declaration. Under subsection 81(1), the Australian Communications and Media Authority (ACMA) is empowered to declare a nominated carrier, in this case, PIPE Networks Pty Ltd, for specific network units owned by TransAct Victoria Communications Pty Ltd, provided the applicant is deemed capable of fulfilling the obligations associated with this role and the declaration does not hinder the efficient administration of telecommunications legislation. Conversely, paragraph 83(2)(b) provides the ACMA with the authority to revoke such a declaration if the nominated carrier relinquishes responsibility for the network units, which is the situation in the document where PIPE Networks Pty Ltd has notified the ACMA of its decision not to accept responsibility for the units. Entities governed by the Act, such as PIPE Networks Pty Ltd and TransAct Victoria Communications Pty Ltd, are subject to specific obligations. PIPE Networks Pty Ltd, as the nominated carrier, must ensure compliance with all obligations under the Act concerning its status as a nominated carrier for the specified network units. This includes maintaining the quality of service, ensuring network reliability, and adhering to any service standards as stipulated by the Telecommunications (Consumer Protection and Service Standards) Act 1999. TransAct Victoria Communications Pty Ltd, the owner of the network units, must cooperate with the nominated carrier to facilitate the provision of services and must also ensure that the network units meet the necessary technical and operational standards. Failure to comply with the provisions of the Telecommunications Act 1997 can result in various consequences, including civil or criminal penalties. The Act does not explicitly state the penalties for breach within the provided excerpt, but it is known that breaches of telecommunications laws can lead to substantial fines and, in severe cases, imprisonment. The ACMA has the authority to impose penalties on entities that fail to meet their obligations under the Act, which could include financial penalties or other enforcement actions. The exact penalties are determined based on the nature and severity of the breach, with maximum penalties potentially reaching significant levels as prescribed by the relevant legislation and regulatory guidelines.
