REVOCATION OF NOMINATED CARRIER DECLARATION – PIPE NETWORKS PTY LTD (NCD 152)

I, Vivian Tee, delegate of the Australian Communications and Media Authority (‘the ACMA’), acting under paragraph 83(2)(b) of the Telecommunications Act 1997 and being satisfied that:

1.    PIPE Networks Pty Ltd (ABN 21 099 104 122) was granted a nominated carrier declaration under subsection 81(1) of the Telecommunications Act 1997 on 6 June 2017 in relation to network units owned by TransAct Victoria Communications Pty Ltd (ACN 063 024 475) (the ‘Nominated Carrier Declaration’), a copy of which is included at Appendix A; and

1.    PIPE Networks Pty Ltd, as the nominated carrier, has given the ACMA a written notice stating it does not accept responsibility for the units for the purposes of the Telecommunications Act 1997;

hereby revoke the Nominated Carrier Declaration under paragraph 83(2)(b) of the Telecommunications Act 1997.

The revocation of the Nominated Carrier Declaration takes effect on 29 July 2025.

Telecommunications Act 1997

Subsection 81(1)

NOMINATED CARRIER DECLARATION

After considering an application dated 18 May 2017 made to the Australian Communications and Media Authority (ACMA) under section 77 of the Telecommunications Act 1997 by Pipe Networks Pty Ltd (the applicant) in relation to network unit or units (the network unit or units) owned by TransAct Victoria Communications Pty Ltd, I, Helen Syrrakos, Section Manager, delegate of the ACMA, acting under subsection 81(1) of the Telecommunications Act 1997, being satisfied that:

(a)  if the applicant were declared to be the nominated carrier in relation to the network unit or units, it would be in a position to comply with all of the obligations imposed on the applicant in the applicant’s capacity as the nominated carrier in relation to the network unit or units; and

(b)  the making of the declaration will not impede the efficient administration of:

(i) the Telecommunications Act 1997; or

(ii) the Telecommunications (Consumer Protection and Service Standards) Act 1999 and regulations under that Act;

declare that Pipe Networks Pty Ltd is the nominated carrier in relation to the hybrid fibre optic and coaxial broadband cable networks owned by TransAct Victoria Communications Pty Ltd ACN 063 024 475 and located in the regional cities of Mildura, Ballarat and Geelong.
