Paragraph 83(2)(b)

 

REVOCATION OF NOMINATED CARRIER DECLARATION – O3b Teleport Services (Australia) Pty Ltd (NCD number 127)

 

I, Dominic Byrne, delegate of the Australian Communications and Media Authority (‘the ACMA’), acting under paragraph 83(2)(b) of the Telecommunications Act 1997 and being satisfied that:

(a)  O3b Teleport Services (Australia) Pty Ltd (ACN 161 700 509) was granted a nominated carrier declaration under subsection 81(1) of the Telecommunications Act 1997 on 8 October 2013 in relation to network units owned by O3b Limited (the ‘Nominated Carrier Declaration’), a copy of which is included in Attachment A; and

(b)  O3b Teleport Services (Australia) Pty Ltd (ACN 161 700 509) has provided the ACMA with a written notice stating that it does not accept responsibility for the network units for the purposes of the Telecommunications Act 1997;

hereby revoke the Nominated Carrier Declaration under paragraph 83(2)(b) of the Telecommunications Act 1997.

AUSTRALIAN COMMUNICATIONS AND MEDIA AUTHORITY

Telecommunications Act 1997

Subsection 81(1)

NOMINATED CARRIER DECLARATION

 

After considering an application dated 16 August 2013 made to the Australian Communications and Media Authority (ACMA) under section 77 of the Telecommunications Act 1997 by 03b Teleport Services (Australia) Pty Ltd (ACN: 161 700 509) (the applicant) in relation to a network, unit or units of the satellite-based facilities owned by 03b Limited (the network unit or units), I, Bridget Smith, Section Manager, delegate of the ACMA, acting under subsection 81(1) of the Telecommunications Act 1997, being satisfied that:

(a)   if the applicant were declared to be the nominated carrier in relation to the network unit or units, it would be in a position to comply with all of the obligations imposed on the applicant in the applicant's capacity as the nominated carrier in relation to the network unit or units; and

 

(b)   the making of the declaration will not impede the efficient administration of:

(i)      the Telecommunications Act 1997;

(ii)    the Telecommunications (Consumer Protection and Service Standards) Act 1999 and regulations under that Act; or

(iii)   the Telecommunications Universal Service Management Agency Act 2012;

declare that 03b Teleport Services (Australia) Pty Ltd is the nominated carrier in relation to the network unit or units of the satellite-based facilities owned by 03b Limited.
