OFFSHORE PETROLEUM AND GREENHOUSE GAS STORAGE ACT 2006

PROHIBITION OF ENTRY INTO A PETROLEUM SAFETY ZONE

 

I, Jeremy Dunster, a representative of the National Offshore Petroleum Safety and Environmental Management Authority [NOPSEMA], pursuant to section 616 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006, hereby prohibit all vessels other than vessels under the control of the registered operator of the North Rankin Complex, in title area WA-1-L and vessels operated by authorised persons who are exercising powers under section 615(1) of Division 1 of Part 6.6 of the above Act from entering or being present in the area of the petroleum safety zone without the consent in writing of NOPSEMA. 

 

This petroleum safety zone extends to a distance of 500 metres, measured from each point of the outer edge of the fixed offshore platform structure known as the North Rankin Complex

(latitude 19° 35’ 07.84” South, longitude 116° 08’ 11.87” East*)

*Note: the above are GDA94 coordinates.

 

The petroleum safety zone will be valid from 28 November 2016 until revoked by notice published in the gazette.

 

Where an unauthorised vessel enters or remains in the safety zone specified in contravention of this notice, the owner and the person in command or in charge of the vessel are each guilty of an offence against Section 616 of the Act and are punishable, upon conviction, by imprisonment for a term:

 

  • not exceeding 15 years if the breach is determined as intentional.
  • not exceeding 12.5 years if the breach is determined as recklessness.
  • not exceeding 10 years if the breach is determined as negligence.
  • not exceeding 5 years if the breach is determined as an offence of strict liability.

 

REVOCATION

 

The previous notice published in the State of Western Australia Government Gazette, GN31, 07 May 1982, pg1467, is revoked as at 28 November 2016.

Overview

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted to address the need for effective regulation of offshore petroleum activities and greenhouse gas storage within Australian jurisdiction, ensuring safety and environmental protection. The Act was passed by the Parliament of Australia to provide a comprehensive legal framework governing the exploration, production, and storage of offshore petroleum resources and greenhouse gases, with an emphasis on minimising environmental risks and ensuring the safety of operations. The policy objective underpinning the Act is to safeguard the marine environment, public health, and safety while facilitating the responsible development of Australia's offshore petroleum resources. The Act empowers the National Offshore Petroleum Safety and Environmental Management Authority to implement and enforce regulations, including the establishment of safety zones and prohibitions on unauthorised vessel entry to protect operational areas from potential hazards. In line with these objectives, the National Offshore Petroleum Safety and Environmental Management Authority has issued a notice under section 616 of the Act, prohibiting vessels not under the control of the registered operator of the North Rankin Complex from entering a specified petroleum safety zone. This zone extends to a radius of 500 metres from the outer edge of the North Rankin Complex, effective from 28 November 2016. The notice serves to reinforce the safety measures around offshore operations and penalise violations with significant penalties, reflecting the serious nature of unauthorised entries into designated safety areas.

Scope and Application

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 governs the regulation of offshore petroleum activities and greenhouse gas storage in Australia, and the prohibition of entry into a petroleum safety zone applies to all vessels in the specified title area WA-1-L, except those under the control of the registered operator of the North Rankin Complex and those operated by authorised persons exercising powers under the Act. Additionally, the notice revokes the previous notice published in the State of Western Australia Government Gazette, GN31, dated 7 May 1982, effective from 28 November 2016.
