Commonwealth of Australia OFFSHORE PETROLEUM AND GREENHOUSE GAS STORAGE ACT 2006 PROHIBITION OF ENTRY INTO A PETROLEUM SAFETY ZONE |
I, Jeremy Dunster, a representative of the National Offshore Petroleum Safety and Environmental Management Authority [NOPSEMA], pursuant to section 616 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006, hereby prohibit all vessels other than vessels under the control of the registered operator of the Enfield Nganhurra FPSO, in the title area WA-28-L and vessels operated by authorised persons who are exercising powers under section 615(1) of Division 1 of Part 6.6 of the above Act from entering or being present in the area of the petroleum safety zone without the consent in writing of NOPSEMA.
This petroleum safety zone extends to a distance of 500 metres, measured from each point of the outer edge of the
- structure known as the Enfield Nganhurra FPSO Riser Turret Mooring System (RTM)
(latitude 21° 28’ 53.36” South, longitude 114° 00’ 29.38” East*); - well known as DCA 1 well (latitude 21° 28’ 54.23” South, longitude 113° 59’ 21.20” East.*);
- well known as DCB 2 well (latitude 21° 27’ 55.94” South, longitude 113° 59’ 34.83” East.*);
- well known as DCC 3 well (latitude 21° 29’ 15.39” South, longitude 113° 58’ 30.83” East.*);
- well known as DCD 4 well (latitude 21° 30’ 03.52” South, longitude 113° 57’ 51.14” East.*).
*Note: the above are GDA94 coordinates.
The petroleum safety zone will be valid from 28 November 2016 until revoked by notice published in the gazette.
Where an unauthorised vessel enters or remains in the safety zone specified in contravention of this notice, the owner and the person in command or in charge of the vessel are each guilty of an offence against Section 616 of the Act and are punishable, upon conviction, by imprisonment for a term:
- not exceeding 15 years if the breach is determined as intentional.
- not exceeding 12.5 years if the breach is determined as recklessness.
- not exceeding 10 years if the breach is determined as negligence.
- not exceeding 5 years if the breach is determined as an offence of strict liability.
REVOCATION
The previous notice published in the State of Western Australia Government Gazette, GN227, 09 December 2005, pg 5906, is revoked as at 28 November 2016.

Overview

The policy objective of the Act is to provide for the sustainable development of offshore petroleum resources while ensuring that activities are conducted safely and in an environmentally responsible manner. The Act empowers the National Offshore Petroleum Safety and Environmental Management Authority (NOPSEMA) to issue prohibition notices, such as the one restricting entry into a petroleum safety zone, to manage and mitigate risks associated with offshore operations. This legislative framework aims to strike a balance between fostering the nation's energy sector and safeguarding marine ecosystems and public safety.
Scope and Application
The Offshore Petroleum and Greenhouse Gas Storage Act 2006 applies to a range of entities and persons involved in the exploration, production, and storage of petroleum and greenhouse gas offshore Australia. Specifically, the Act governs the activities of operators and their vessels, equipment, and personnel in designated offshore areas, ensuring compliance with safety and environmental standards. The Act also imposes responsibilities on the National Offshore Petroleum Safety and Environmental Management Authority (NOPSEMA) to regulate and oversee these activities to prevent accidents, pollution, and other risks associated with offshore petroleum operations. The geographic scope of the Act extends to Australian waters, including state and territorial waters, as well as the Australian exclusive economic zone. However, the Act does not apply to activities conducted on the continental shelf of a foreign state unless there is an agreement in place with that state. Additionally, the Act provides for certain exclusions and exemptions, such as for research and exploration activities conducted under specific conditions, and the use of certain types of equipment or vessels.
The prohibition of entry into a petroleum safety zone, as outlined in the notice issued under section 616 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006, specifically applies to all vessels other than those under the control of the registered operator of the Enfield Nganhurra FPSO and vessels operated by authorised persons exercising powers under section 615(1) of Division 1 of Part 6.6 of the Act. For instance, an intentional breach carries a maximum penalty of 15 years, whereas negligence results in a maximum penalty of 10 years. Recklessness and strict liability breaches are subject to 12.5 and 5 years of imprisonment, respectively.
Failure to comply with the provisions of this notice may result in severe civil and criminal consequences. The penalties for breaching the prohibition are significant, reflecting the importance of maintaining the integrity of the petroleum safety zone. The maximum penalties serve as a deterrent against unauthorised entry into the safety zone, ensuring that activities within the zone remain controlled and safe.
