REVOCATION OF A PETROLEUM SAFETY ZONE

 

 

I, Percy Dhanbhoora, a representative of the National Offshore Petroleum Safety and Environmental Management Authority [NOPSEMA], hereby revoke Notice A689136 which appeared in the Commonwealth of Australia Government Gazette on 30 August 2019, C2019G00771, in relation to the Prohibition of Entry into a Petroleum Safety Zone associated with the Sculpin-1 well in VIC/P70.

Overview

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted to provide a framework for the regulation of activities related to offshore petroleum and greenhouse gas storage. It was introduced to address the need for a comprehensive regulatory scheme to ensure safety, environmental protection, and efficient use of resources in offshore petroleum and greenhouse gas operations. This legislation empowers the National Offshore Petroleum Safety and Environmental Management Authority [NOPSEMA] to establish safety zones and enforce safety regulations, thereby minimising risks associated with offshore operations. The policy objective of this Act is to protect the health and safety of workers, the public, and the environment while promoting the responsible development of offshore resources. In this context, the revocation of a Petroleum Safety Zone by NOPSEMA under this Act serves to adjust regulatory measures in response to changes in operational conditions, ensuring ongoing compliance with safety standards.

Scope and Application

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 applies to any person or entity involved in offshore petroleum activities, including exploration, production, refining, and transportation, as well as the storage of greenhouse gases in Australia. This Act is a Commonwealth legislation and therefore extends across all offshore areas within Australia's jurisdiction, including the territorial sea and the Exclusive Economic Zone. The Act governs the regulation of safety and environmental management in offshore petroleum activities and greenhouse gas storage, ensuring that these activities are conducted in a manner that protects the health and safety of workers, the public, and the environment. The Act provides the National Offshore Petroleum Safety and Environmental Management Authority with the power to issue permits, directions, and orders to ensure compliance with the Act's requirements. Certain exclusions apply to the Act, including petroleum activities conducted on a rig, vessel, or platform wholly within a state's internal waters, and greenhouse gas storage activities that are not offshore. The Act also provides for the creation of subordinate legislation to further extend or restrict its application.

Key Provisions

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 (the 'Act') provides the legal framework for the regulation of offshore petroleum activities and greenhouse gas storage in Australia. In relation to the revocation of a petroleum safety zone, section 53(1) of the Act empowers the National Offshore Petroleum Safety and Environmental Management Authority (NOPSEMA) to designate safety zones to protect people and the environment during offshore petroleum activities. The revocation of a safety zone, as seen in Notice A729970, occurs when NOPSEMA determines that the conditions that necessitated the safety zone no longer exist, allowing for the resumption of normal activities in the area. The authority to revoke such a zone is exercised by issuing a notice in the Commonwealth of Australia Government Gazette, as is evident in the revocation of the safety zone associated with the Sculpin-1 well in VIC/P70. The Act imposes several obligations on NOPSEMA and other relevant parties when it comes to the establishment and revocation of petroleum safety zones. Under section 53(2), NOPSEMA must ensure that any safety zone established is reasonable and necessary for the protection of health, safety, and the environment. When revoking a safety zone, NOPSEMA is required to provide a clear and detailed explanation for the revocation, including the circumstances that led to the initial establishment of the zone and the reasons for its revocation. This is to maintain transparency and ensure that all stakeholders are informed of the changes. Additionally, section 56(1) of the Act requires that notices of such revocations be published in the Commonwealth of Australia Government Gazette to ensure wide dissemination of the information. The Act also outlines specific offences and penalties for breaches of its provisions. Under section 142, any person who contravenes a provision of the Act, including the improper revocation or establishment of a petroleum safety zone, is subject to criminal penalties. For individuals, the maximum penalty is a fine of up to 5,000 penalty units or imprisonment for up to five years, or both. For corporations, the maximum penalty is significantly higher, reaching up to 25,000 penalty units. These penalties serve as a deterrent against non-compliance and underscore the seriousness with which the Act treats the protection of health, safety, and the environment in offshore petroleum activities. Furthermore, civil consequences may also apply under section 143, which allows for actions seeking compensation for any loss or damage caused by a breach of the Act.
