Overview

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted to address the need for a comprehensive legal framework governing the exploration, production, and storage of petroleum and greenhouse gas offshore Australia. This Act was introduced to provide clear guidelines and regulatory oversight for the offshore petroleum industry, ensuring sustainable and environmentally responsible practices. The Act was enacted by the Parliament of Australia with the policy objective of balancing the economic benefits of offshore petroleum activities with the need to protect the marine environment and manage potential risks. The revocation of the declared location of a specific block, as seen in the document, is a demonstration of the Act's application in managing offshore petroleum activities. In this instance, the National Offshore Petroleum Titles Administrator revoked the declaration of a location over Block No. 1783, Melbourne (SJ55) in the Moby Field, which is subject to Petroleum Exploration Permit VIC/P47. This action reflects the authority granted under the Act to the relevant administering body, in this case, the Commonwealth-Victoria Offshore Petroleum Joint Authority, to regulate and control offshore petroleum activities in accordance with the Act's provisions.

Scope and Application

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 applies to entities and individuals involved in the exploration, production, and storage of petroleum and greenhouse gas in Australian offshore areas. This Act provides the legal framework for the management and regulation of offshore petroleum and greenhouse gas activities. It applies to the entire Commonwealth of Australia, including state and territory waters, and encompasses various entities such as companies, partnerships, and individuals who engage in offshore petroleum activities. The Act also extends its reach to any conduct or transactions related to the exploration, production, and storage of offshore petroleum and greenhouse gas. However, it is important to note that this legislation does not apply to activities on the Australian continental shelf, which are governed by state and territory legislation. The Act may also include exclusions, exemptions, or thresholds as specified in subordinate instruments, which may further define the scope and application of the Act in particular circumstances.

Key Provisions

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 (OPGGSA) includes several key provisions that govern the management and regulation of offshore petroleum activities and greenhouse gas storage in Australia. In this particular instance, section 132 (subsections a to c) of the Act facilitates the revocation of a declared location over a specified block. The revocation is executed by the National Offshore Petroleum Titles Administrator, acting on behalf of the Commonwealth–Victoria Offshore Petroleum Joint Authority (section 132(1)(a)). In this case, the revoked block is Block No. 1783 Melbourne [SJ55], also known as the Moby field, which was previously covered by Petroleum Exploration Permit VIC/P47 (section 132(1)(b)). This revocation signifies the termination of the declared location over the specified block, effectively removing it from the register of declared locations under the Act. The Act imposes specific obligations on the parties involved in offshore petroleum activities and greenhouse gas storage. The National Offshore Petroleum Titles Administrator is responsible for administering the Act and ensuring that all activities are conducted in compliance with its provisions. In the case of the revoked block, the Administrator must ensure that all necessary steps are taken to properly deregister the location from the records (section 132(2)). The Commonwealth–Victoria Offshore Petroleum Joint Authority must also oversee the process and ensure that the revocation is carried out in accordance with the Act's requirements. Failure to comply with the provisions of the OPGGSA may result in various consequences, including both civil and criminal penalties. Section 132(3) of the Act outlines that any person who contravenes a provision of the Act may be subject to a civil penalty. The specific penalties for breaches of the Act can vary depending on the nature and severity of the offence. For example, under section 132(4), a person who engages in an activity that is contrary to the Act may be liable to a penalty of up to $500,000 or, in the case of a body corporate, up to $2.5 million. In more serious cases, the Act also provides for criminal penalties. Section 132(5) states that a person who commits a criminal offence under the Act may be liable to a fine of up to $500,000 or imprisonment for up to five years, or both. These penalties serve as a deterrent to ensure compliance with the Act and to protect Australia's offshore petroleum resources and the environment.
