REVOCATION OF A PETROLEUM SAFETY ZONE

I Jeremy Dunster a representative of the National Offshore Petroleum Safety and Environmental Management Authority [NOPSEMA], hereby revoke the Notice which appeared in the West Australian Government Gazette No.210 of 11 November 2005 in relation to the Prohibition of Entry into a Safety Zone established for the registered holders of Production Licence WA-31-L for the Cliff Head A Platform; and Exploration Permits WA-325-P and WA-327-P relating to the following wells:  Frankland 1, Mentelle 2, Dunsborough 1, Flying Foam 1, and Blue Jacket 1.

 

Revocation effective as of 29 May 2014.

PROHIBITION OF ENTRY INTO A PETROLEUM SAFETY ZONE

 

I, Jeremy Dunster a representative of the National Offshore Petroleum Safety and Environmental Management Authority [NOPSEMA], pursuant to section 616 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006, hereby prohibit all vessels other than vessels under the control of Roc Oil (WA) Pty Ltd the registered holders of Production Licence WA-31-L, commercial fishing vessels operated by parties to ,and in accordance with, a Memorandum of understanding with Roc Oil (WA) Pty Ltd regarding entry and presence in the petroleum safety zone and vessels operated by authorised persons who are exercising powers under section 615(1) of Division 1 of Part 6.6 of the above Act from entering or being present in the area of the petroleum safety zone without the consent in writing of NOPSEMA.

 

This petroleum safety zone extends to a distance of 500 metres, measured from each point of the outer edge of the facility known as the Cliff Head A platform.

*Note: the above are GDA94 coordinates.

 

The petroleum safety zone will be valid from 29 May 2014 until revoked by notice published in the gazette.

 

Where an unauthorised vessel enters or remains in the safety zone specified in contravention of this notice, the owner and the person in command or in charge of the vessel are each guilty of an offence against Section 616 of the Act and are punishable, upon conviction, by imprisonment for a term:

 

  • not exceeding 15 years if the breach is determined as intentional.
  • not exceeding 12.5 years if the breach is determined as recklessness.
  • not exceeding 10 years if the breach is determined as negligence.
  • not exceeding 5 years if the breach is determined as an offence of strict liability.

Overview

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted by the Commonwealth Parliament to address the need for comprehensive regulation of offshore petroleum activities and greenhouse gas storage, ensuring safety and environmental protection. The Act provides a framework for the regulation of exploration, production, and storage of petroleum and greenhouse gases offshore Australia, aiming to balance economic interests with the need to protect the marine environment and public safety. The National Offshore Petroleum Safety and Environmental Management Authority (NOPSEMA) is the principal regulatory body established under this Act, tasked with implementing the policy objectives of safe and environmentally responsible offshore petroleum and greenhouse gas activities. The revocation and establishment of petroleum safety zones, as evidenced by the recent notices, are part of the regulatory measures to manage risks associated with offshore operations, ensuring compliance with safety and environmental standards.

Scope and Application

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 applies to entities and individuals involved in offshore petroleum activities and greenhouse gas storage operations within Australian waters. Specifically, the Act regulates the establishment and management of petroleum safety zones, the authorisation of activities, and the imposition of safety and environmental management measures. It applies to production licence holders, exploration permit holders, and any vessels or personnel operating in the designated safety zones. The geographic reach of the Act extends to Australian offshore areas, including state waters and the Australian Exclusive Economic Zone. The Act provides for the creation of safety zones around offshore facilities to ensure the safety of operations and the protection of the environment. Subordinate instruments may further define the specific requirements and standards for safety and environmental management in these zones. Certain activities and entities may be exempt or subject to different thresholds under the Act, as detailed in the legislation and associated regulations. The Act also allows for the revocation of safety zones and other measures through notices published in the gazette, as demonstrated in the revocation of the petroleum safety zone for the Cliff Head A Platform.

Key Provisions

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 includes provisions for the establishment and revocation of petroleum safety zones. Section 616 of the Act allows the National Offshore Petroleum Safety and Environmental Management Authority (NOPSEMA) to prohibit entry into such zones. In this case, NOPSEMA has issued a notice prohibiting vessels, other than those controlled by Roc Oil (WA) Pty Ltd, commercial fishing vessels operating under a specific memorandum of understanding with Roc Oil, and vessels operated by authorised persons exercising certain powers, from entering a designated safety zone without written consent from NOPSEMA. This safety zone extends 500 metres from the Cliff Head A platform, located at specified coordinates. The notice, which was initially published in the West Australian Government Gazette on 11 November 2005, has been revoked as of 29 May 2014. Entities and individuals subject to this Act must adhere to the requirements and prohibitions set out in the safety zone notice. Specifically, they must ensure that vessels do not enter the prohibited zone without NOPSEMA's consent. This includes vessels under the control of Roc Oil (WA) Pty Ltd, commercial fishing vessels with a valid memorandum of understanding, and vessels operated by authorised persons exercising powers under section 615(1) of the Act. Failure to comply with these provisions may result in legal consequences. The Act imposes significant penalties for breaches of the safety zone provisions. Under Section 616, both the owner and the person in command or in charge of a vessel that enters or remains in the safety zone without consent are liable for an offence. The penalties vary depending on the nature of the breach. For an intentional breach, the maximum penalty is imprisonment for up to 15 years. If the breach is deemed reckless, the maximum penalty is imprisonment for up to 12.5 years. For negligence, the maximum penalty is imprisonment for up to 10 years, and for an offence of strict liability, the maximum penalty is imprisonment for up to 5 years. These stringent penalties underscore the importance of compliance with the safety zone regulations to protect offshore petroleum operations and environmental safety.
