Overview

The Retirement Assistance for Farmers Scheme Extension Act 2000 was enacted to address the problem of extending the eligibility period for farmers under the Retirement Assistance for Farmers Scheme. This scheme, as initially provided under the Social Security Act 1991 and the Veterans’ Entitlements Act 1986, was set to expire on 15 September 2000. The Act was introduced by the Parliament of Australia to amend these two Acts, thereby extending the eligibility period for farmers to 1 July 2001. This extension aimed to provide continued support for farmers who were nearing retirement but had not yet qualified for the scheme under the original timeframe.

Scope and Application

The Retirement Assistance for Farmers Scheme Extension Act 2000 is a Commonwealth Act that amends the Social Security Act 1991 and the Veterans’ Entitlements Act 1986. This Act extends the eligibility period for farmers to receive retirement assistance under these Acts from 15 September 2000 to 1 July 2001. The legislation applies to farmers and their spouses or partners who are recipients of benefits under the amended Acts. The amendments are made through the Schedules of the Act, which detail the specific changes to be made to the relevant sections of the Social Security Act 1991 and the Veterans’ Entitlements Act 1986. The Act applies nationally, as it is a Commonwealth Act, and there are no stated exclusions, exemptions, or thresholds within the text of the Act itself. However, the application of the amended provisions would be subject to the specific criteria and conditions set out in the Social Security Act 1991 and the Veterans’ Entitlements Act 1986. The Act does not explicitly extend or restrict its application through subordinate instruments, but such instruments may be used to provide further detail or guidance on the implementation of the amendments.

Key Provisions

The Retirement Assistance for Farmers Scheme Extension Act 2000 amends two key pieces of legislation, namely the Social Security Act 1991 and the Veterans’ Entitlements Act 1986, by extending the retirement assistance scheme for farmers. Specifically, Section 1 of the Act updates the expiry dates for certain provisions from 15 September 2000 to 1 July 2001. This is achieved through Schedule 1, which targets various sections of the Social Security Act 1991, and Schedule 2, which addresses equivalent sections of the Veterans’ Entitlements Act 1986. The operative sections of the Act, detailed in Schedules 1 and 2, essentially extend the eligibility period for farmers to apply for retirement assistance. This means that the timeframe within which farmers can access these benefits has been lengthened, providing more time for those who may need it to make their applications. The changes primarily involve substituting the date of 15 September 2000 with 1 July 2001 across multiple subsections in both Acts, ensuring consistency in the extended period. The Act imposes specific obligations on the relevant parties, namely farmers who are eligible to apply for retirement assistance under the schemes outlined in the Social Security Act 1991 and the Veterans’ Entitlements Act 1986. These farmers must now be aware of and act within the new timeframe, ensuring their applications are made by the extended date of 1 July 2001. Additionally, the relevant authorities must facilitate these applications within the new parameters set by the Act, ensuring that the extended provisions are implemented correctly. There are no explicit offences or penalties outlined in the Act for non-compliance with the extended dates. However, the failure to submit applications by the new deadline of 1 July 2001 could mean that eligible farmers miss out on the retirement assistance benefits. This could have significant financial implications for those farmers who do not successfully apply within the new timeframe. The consequences are primarily civil in nature, as the Act does not stipulate criminal penalties for missing the extended application date.
