Overview

The Australian National University Residential Colleges Affiliation Rules 2013 were introduced to formalise the behavioural standards and disciplinary procedures expected from members, non-resident members, and visitors of affiliated residential colleges. Enacted under the authority of the Residential Colleges Affiliation Statute 2013, section 13, these rules require affiliated colleges to draft their own rules pertaining to behaviour and conduct, which will then be incorporated into the overarching rules as a schedule. This legislative instrument was developed by the Council of the Australian National University at its meeting on 4 October 2013, with a focus on maintaining a structured and consistent approach to governance and risk management within the university’s residential college system. The overarching policy objective is to ensure a safe, respectful, and orderly environment conducive to academic and personal growth for all individuals associated with the residential colleges.

Scope and Application

The Australian National University Residential Colleges Affiliation Rules 2013, established under the authority of the Residential Colleges Affiliation Statute 2013, section 13, apply to affiliated residential colleges within the Australian National University (ANU). These rules mandate that each affiliated residential college must draft internal rules pertaining to the behavioural standards expected of its members, non-resident members, and visitors. Additionally, these colleges are required to submit specific reports concerning disciplinary actions and conduct to the university. The college rules are incorporated into these overarching rules as a schedule. The rules do not explicitly mention any exclusions, exemptions, or thresholds, nor do they indicate any geographic or jurisdictional reach beyond the institution of the Australian National University. The rules were formulated through an internal process by the Council of the University at its meeting on 4 October 2013, with input from Corporate Governance and Risk on 8 October 2013. The rules themselves do not extend or restrict application through subordinate instruments, as indicated by the absence of any incorporated documents by reference.

Key Provisions

The Australian National University Residential Colleges Affiliation Rules 2013 (the "Rules") are designed to govern the behaviour and conduct of members, non-resident members, and visitors of affiliated residential colleges within the University (section 2). These affiliated residential colleges are required to draft and maintain rules that outline the standards of behaviour expected from their members, non-resident members, and visitors. These rules must be consistent with the overarching principles and values of the University and are subject to the approval of the University’s Council (section 3). Once approved, these rules become part of the Rules as a schedule (section 4). The Rules impose several obligations on affiliated residential colleges. Firstly, they must ensure that their members, non-resident members, and visitors adhere to the standards of behaviour as outlined in their drafted rules (section 3). This includes fostering a respectful and safe environment within the college. Secondly, the colleges must report to the University on any disciplinary actions taken and provide updates on the conduct of their members and visitors (section 2). These reports are essential for the University to maintain oversight and ensure compliance with the established standards. The Rules also require colleges to maintain records of any disciplinary actions and make these records available to the University upon request (section 5). Breach of the Rules can lead to various consequences, both civil and criminal. For instance, failure to adhere to the standards of behaviour may result in disciplinary action by the college, which could include warnings, fines, suspension, or expulsion from the college (section 6). Additionally, if the breach is severe, it could lead to criminal charges, particularly if the conduct involves illegal activities or significant harm to others. The specific penalties for breaches are not explicitly detailed in the Explanatory Statement but are generally aligned with the severity of the misconduct and the policies of the individual colleges as approved by the University (section 7). It is important to note that these penalties can vary widely depending on the nature and context of the breach.
