REMUNERATION TRIBUNAL
Explanatory Statement: Determination 2012/08
Remuneration and Allowances for Holders of Public Office
1. The Remuneration Tribunal has inquired into and determined the remuneration and significantly related matters for office holders, as it is empowered to do by the Remuneration Tribunal Act 1973.
2. In making this determination the Tribunal has informed itself through consultation in accordance with established practice.
3. Any retrospective application of this determination is in accordance with subsection 12(2) of the Legislative Instruments Act 2003 as it does not affect the rights of a person (other than the Commonwealth or an authority of the Commonwealth) to that person’s disadvantage, nor does it impose any liability on such a person.
4. This Determination is compatible with the human rights or freedoms recognised or declared in the international instruments listed in section 3 of the Human Rights (Parliamentary Scrutiny) Act 2011. This Determination does not engage any of the applicable rights or freedoms.
PART 1 – FULL-TIME OFFICES
5. Clause 1.1 specifies the Principal Determination (Number 8 of 2011 as amended) for the purposes of Part 1 of the Determination.
6. Clause 1.2 to 1.4 sets remuneration for the offices of Director, Australian Institute of Criminology and Chief Executive Officer, Australian Transaction Reports and Analysis Centre. The date of effect is from 28 March 2012. These offices were previously in the Principal Executive office structure.
7. Clauses 1.5 to 1.9 increase the remuneration of full-time office holders associated with the following bodies: Productivity Commission, National Offshore Petroleum Safety and Environmental Management Authority and Australian Communications and Media Authority. The date of effect is from 1 May 2012.
8. Clauses 1.10 to 1.11 set remuneration for the office of Chief Executive Officer, Austrade. The date of effect is from 1 May 2012 This office was previously in the Principal Executive office structure.
9. Clauses 1.12 and 1.13 remove all reference to additional remuneration determined for Dr Peter Boxall, Member, ASIC.
10. Clauses 1.14 and 1.15 set a personal loading for the current General Manager, Aboriginal Hostels Limited, Ms Joy Savage and remove all reference to additional remuneration determined for the former General Manager, Mr Roger Barson.
11. Clauses 1.16 and 1.17 set remuneration for the new office of Parliamentary Budget Officer.
12. Clauses 1.18 and 1.19 set a personal loading for the Deputy Australian Building and Construction Commissioner, Mr Brian Corney, from 11 July 2011 until 31 May 2012.
13. Clauses 1.20 to 1.22 set remuneration for the new office of Director, Fair Work Building Industry Inspectorate, from 1 June 2012.
PART 2 – PART-TIME OFFICES
14. Clause 2.1 specifies the Principal Determination (Number 9 of 2011 as amended) for the purposes of Part 2 of the Determination.
15. Clauses 2.2 and 2.3 move the Member, Medical Services Advisory Committee from Schedule B to Schedule A, Table A1A.
16. Clause 2.4 deletes all reference to the ABC – Independent Complaints Review Panel, Tuggeranong Office Park Pty Limited, Information Industries Board and Council of Business Regulation. These bodies have been abolished.
17. Clauses 2.5 to 2.8 set remuneration for the new office of Independent Assessor – Special Building Industry Powers, with effect on and from 1 June 2012.
