Explanatory Statement: Determination 2011/13
Remuneration and Allowances for Holders of Public Office
1. The Remuneration Tribunal has inquired into and determined the remuneration and significantly related matters for office holders, as it is empowered to do by the Remuneration Tribunal Act 1973.
2. In making this determination the Tribunal has informed itself through consultation in accordance with established practice.
3. Any retrospective application of this determination is in accordance with subsection 12(2) of the Legislative Instruments Act 2003 as it does not affect the rights of a person (other than the Commonwealth or an authority of the Commonwealth) to that person’s disadvantage, nor does it impose any liability on such a person.
PART 1 – FULL-TIME OFFICES
4. Clause 1.1 specifies the Principal Determination (Number 8 of 2011) for the purposes of Part 1 of the Determination.
5. Clauses 1.2 to 1.3 set remuneration for the new office of Chief Executive Officer, ComSuper, with effect on and from 1 July 2011.
6. Clauses 1.4 to 1.5 set remuneration for the new offices of Chief Commissioner, Chief Executive Officer, Deputy Commissioner and Commissioner of the Australian Skills Quality Agency with effect on and from 1 July 2011.
7. Clauses 1.6 to 1.7 set remuneration for the new office of Chief Executive Officer, Australian National Preventative Health Agency with effect on and from 1 July 2011.
PART 2 – PART-TIME OFFICES
8. Clause 2.1 specifies the Principal Determination (Number 9 of 2011) for the purposes of Part 2 of the Determination.
9. Clauses 2.2 to 2.3 set remuneration for the new offices of Chair and Director of Outback Stores Pty Ltd with effect on and from 1 July 2011.
10. Clauses 2.4 to 2.5 set remuneration for the new offices of Chair and Member of the Defence Force Case Assessment Panel with effect on and from 1 July 2011.
11. Clauses 2.6 to 2.8 set remuneration for the new office Member of the Review of the Distribution of the Goods and Services Tax with effect on and from 1 July 2011.
12. Clauses 2.9 to 2.11 set remuneration for the new offices of Chair and Member of the Ministerial Advisory Council on Regional Australia and the Regional Development Australia Fund Advisory Panel, with effect on and from 1 July 2011.
13. Clause 2.12 makes it clear that clause A8 of the Principal Determination is applicable to Members and Directors, however named, of the relevant bodies.
14. Clause 2.13 to 2.15 set remuneration for the new offices of Chair and Director of the Commonwealth Superannuation Corporation, with effect on and from 1 July 2011. They also provide temporary loadings for these offices, in each case until 30 June 2012.
15. Clauses 2.16 to 2.18 set annual fees for the Chair and Director of the Australian Solar Institute, in place of the previously determined daily fees. They also provide additional fees for Directors who are also appointed to that body’s Audit and Risk Committee. Both changes take effect on and from 1 July 2011.
16. Clauses 2.19 to 2.20 set remuneration for the newly established Advisory Committee for Biologicals with effect on and from 1 July 2011.
