Overview

The Remuneration Tribunal Determination 2011/07, issued under the Remuneration Tribunal Act 1973, was enacted to determine the remuneration and related matters for specific holders of public office. This determination was made to ensure fair and consistent pay adjustments across certain statutory positions, with the objective of aligning salaries with inflationary changes and maintaining the integrity of public sector remuneration. The Tribunal, acting pursuant to its legislative mandate, reviewed the previous remuneration rates and decided on a 3% increase effective from 1 July 2011. This determination supersedes the previous principal Determination 2010/13, ensuring that the remuneration for the specified statutory offices reflects the updated rates. The policy objective behind this determination is to provide a transparent and methodical approach to adjusting the salaries of public office holders, ensuring their remuneration remains competitive and reflective of current economic conditions.

Scope and Application

The Remuneration Tribunal, empowered by the Remuneration Tribunal Act 1973, has issued Determination 2011/07 which pertains to the remuneration and related matters of certain holders of public office. This determination applies to specified statutory officers, providing increased base salary and total remuneration effective from 1 July 2011, reflecting a 3 per cent increase (rounded) from the previous rates. The determination revokes and supersedes the previous Determination 2010/13, ensuring that the updated rates are applicable from the specified date. The provisions concerning official travel, compensation for early loss of office, and recreation leave have remained unchanged from the previous determination, maintaining consistency in these areas. The authority for this determination is derived from sub-sections 7(3) and 7(4) of the Remuneration Tribunal Act 1973, and the determination applies nationally, impacting various offices as listed in the document.

Key Provisions

The main operative sections of the Determination 2011/07 specify the authority for and the date of effect of the determination, and they define terms used within the document. Section 3 establishes the authority for the determination under the Remuneration Tribunal Act 1973, and it revokes and supersedes the previous principal Determination 2010/13. The definitions in Part 1 provide clarity on terms such as "Base Salary" and "Total Remuneration" that are used throughout the Determination. Part 2 details the new Base Salary and Total Remuneration rates for Specified Statutory Offices, which have been increased by 3 per cent following a review of remuneration, effective from 1 July 2011. The obligations and requirements imposed by the Act on the parties it governs include the provision of increased remuneration for certain public office holders as determined by the Remuneration Tribunal. This obligation arises from the authority granted under the Remuneration Tribunal Act 1973. The Determination requires the specified statutory officers to adhere to the updated remuneration rates effective from 1 July 2011, as outlined in Table 1 of Clause 2.1. Furthermore, the Tribunal’s obligation to consult with relevant stakeholders before making such determinations ensures that the remuneration is fair and reflective of the duties involved. The Determination does not explicitly outline specific offences or penalties for breaches of its provisions. However, non-compliance with the remuneration rates and related matters stipulated by the Determination could potentially result in civil or criminal consequences under the Remuneration Tribunal Act 1973. While the Determination itself does not detail these consequences, the overarching legislation likely includes provisions for penalties and enforcement actions against those who fail to adhere to the specified remuneration and allowances. These consequences could include fines or other legal actions, depending on the severity and nature of the breach.
