Overview

The Remuneration Tribunal, established under the Remuneration Tribunal Act 1973, has enacted Determination 2010/07 to address the need for consistent and fair remuneration for holders of part-time public offices. This determination, authorised by the Act, ensures that remuneration and allowances for specific office holders are appropriately set, reflecting their responsibilities and the value of their contributions to public service. The process involves consultation, as mandated by the established practices of the Tribunal, to ensure that the remuneration is both equitable and reflective of the roles undertaken by these office holders. The Explanatory Statement clarifies that any retrospective application of this determination does not adversely affect the rights of individuals, in accordance with the provisions of the Legislative Instruments Act 2003. The primary objective of this determination is to provide clarity and consistency in the remuneration of part-time public office holders, ensuring that their compensation is aligned with the duties and expectations of their roles.

Scope and Application

The Remuneration Tribunal Determination 2010/07 applies to office holders as defined by the Remuneration Tribunal Act 1973, focusing on setting their remuneration and other significantly related matters. The Tribunal consults established practices in making these determinations, ensuring that any retrospective application does not adversely affect the rights of individuals or impose liabilities, as stipulated in the Legislative Instruments Act 2003. This determination specifically addresses part-time offices, with Clause 1.2 to 1.3 setting the remuneration for the new office of Chair and Members of the Apprenticeships for the 21st Century Expert Panel, effective from 1 July 2010. The scope of the legislation is national, given the federal nature of the Remuneration Tribunal Act 1973, which empowers the Tribunal to make such determinations. The application of this determination extends through subordinate instruments as authorised by the primary Act, ensuring its provisions are implemented comprehensively across the specified roles and offices.

Key Provisions

The main operative sections of this determination include the Principal Determination, as specified in Clause 1.1, which references Number 14 of 2009 as amended. This determination applies to part-time offices, specifically establishing the remuneration for the new office of Chair and Members of the Apprenticeships for the 21st Century Expert Panel, effective from 1 July 2010 (Clause 1.2 to 1.3). The Remuneration Tribunal has made these determinations under the authority provided by subsections 7(3) and 7(4) of the Remuneration Tribunal Act 1973. The Remuneration Tribunal Act 1973 mandates that the Tribunal consult and consider relevant matters before making its determinations. In this case, the Tribunal has followed established practice and consulted as required (Section 2). Furthermore, the retrospective application of this determination adheres to subsection 12(2) of the Legislative Instruments Act 2003, ensuring it does not adversely affect the rights of any person (other than the Commonwealth or an authority of the Commonwealth) and does not impose any liability on such persons (Section 3). The Act imposes several obligations on the parties it governs, primarily ensuring that the remuneration and allowances for office holders are determined fairly and in accordance with established practices. The Tribunal must consult with relevant stakeholders and consider all pertinent factors before making its determinations. Additionally, the retrospective application of these determinations must not disadvantage any person other than the Commonwealth or its authorities, and must not impose any liability on such persons (Sections 2 and 3). There are no specific offences or penalties outlined in this determination. However, the Remuneration Tribunal Act 1973 may provide for penalties for breaches of its provisions. Practitioners should refer to the Act for information on potential penalties, which may include fines or other civil and criminal consequences for non-compliance with the Tribunal’s determinations. It is essential for all parties governed by this determination to adhere to the prescribed remuneration and allowances to avoid any potential repercussions.
