Overview

The Remuneration Tribunal Determination 2010/02, issued under the Remuneration Tribunal Act 1973, addresses the remuneration and allowances for various public office holders. Enacted by the Parliament of Australia, the Act was designed to ensure that the remuneration of office holders is fair and commensurate with the responsibilities of their roles. This determination reflects the Tribunal's responsibility to review and set appropriate levels of compensation, thereby aligning with the policy objective of maintaining equitable and transparent remuneration practices. The Tribunal's approach involved consulting established practices and considering the implications of any retrospective applications, ensuring they do not adversely affect the rights of individuals or impose new liabilities, as per the requirements of the Legislative Instruments Act 2003. This determination specifically addresses part-time offices, including setting remuneration for new and existing positions, correcting references, and accounting for the dissolution of certain bodies.

Scope and Application

The Determination 2010/02 issued by the Remuneration Tribunal under the Remuneration Tribunal Act 1973 applies to various part-time office holders, including the Chair of NBN Co Limited, the Chair and Members of the Aboriginals Benefit Account Advisory Committee, and the Chair, Deputy Chair, and Members of the Australian Institute for Teaching and School Leadership Ltd. This Determination sets the remuneration for these offices, and it is retrospective in nature, ensuring that it does not adversely affect the rights of any person other than the Commonwealth or an authority of the Commonwealth. Clauses 1.7 and 1.8 have been included to remove references to the now defunct Teaching Australia – Australian Institute for Teaching and School Leadership, while Clause 1.9 corrects references to the ASADA – Advisory Group without altering the associated fees and entitlements. This legislation operates within the Commonwealth jurisdiction and may be further extended or restricted through subordinate instruments as necessary.

Key Provisions

The Remuneration Tribunal has determined the remuneration and related matters for various office holders under the Remuneration Tribunal Act 1973. Clause 1.1 references the Principal Determination (Number 14 of 2009 as amended), which serves as the basis for the new remuneration rates set forth in the determination. Clause 1.2 establishes the remuneration for the new office of Chair of NBN Co Limited. Clause 1.3 sets the remuneration for the offices of Chair and Members of the Aboriginals Benefit Account Advisory Committee. Furthermore, Clauses 1.4 to 1.6 establish remuneration for the new offices of Chair, Deputy Chair, and Members of the Australian Institute for Teaching and School Leadership Ltd, effective from 1 January 2010. Clauses 1.7 and 1.8 remove references to Teaching Australia – Australian Institute for Teaching and School Leadership, as this body has been replaced by the Australian Institute for Teaching and School Leadership Ltd. Finally, Clause 1.9 corrects references to the ASADA – Advisory Group, without altering the associated fees and entitlements. The Remuneration Tribunal has a responsibility to consult with relevant parties and establish a fair remuneration framework for office holders. This obligation ensures that the remuneration reflects the duties and responsibilities of the offices involved, while maintaining consistency with the existing remuneration framework. In this determination, the Tribunal has followed established practices in consulting with stakeholders and making informed decisions. The Tribunal also ensures that any retrospective application of the determination does not adversely affect the rights of individuals or impose any liability, as outlined in subsection 12(2) of the Legislative Instruments Act 2003. Failure to comply with the provisions of the Remuneration Tribunal Act 1973 may result in legal consequences for the parties or entities governed by the Act. For instance, if an office holder does not receive the remuneration as determined by the Tribunal, or if the remuneration is not adjusted in accordance with the Act, this may result in disputes or legal action. Additionally, if the Tribunal fails to consult with relevant parties or does not follow established practices in making its determinations, this may also lead to legal consequences. It is essential for all parties involved to adhere to the requirements and obligations set forth in the Act to avoid any potential penalties or consequences. The Remuneration Tribunal Act 1973 does not explicitly outline specific offences, penalties, or consequences for breach. However, the Act empowers the Tribunal to determine remuneration and related matters for office holders, which in turn imposes obligations on the parties involved. Failure to comply with the determinations made by the Tribunal may result in disputes, legal action, or other consequences as deemed appropriate by the relevant authorities. It is essential for all parties to adhere to the requirements and obligations set forth in the Act to avoid any potential repercussions.
