Overview
The Remuneration Tribunal Determination 2009/02, issued under the authority of the Remuneration Tribunal Act 1973, sets out the remuneration and allowances for holders of public office. This determination was enacted to address the need for updated and precise remuneration guidelines for various public office holders, ensuring that their compensation is aligned with their roles and responsibilities. The determination was enacted by the Remuneration Tribunal, which was established by the Commonwealth Parliament to provide such determinations and to ensure that remuneration for public office holders is fair and reflective of their duties. The objective is to maintain equitable compensation that is consistent with the responsibilities and public service contributions of these office holders.
The Tribunal consulted established practices and relevant statutes, including the Legislative Instruments Act 2003, to ensure that the determination does not adversely affect the rights of individuals. This determination specifically addresses changes in office status, such as the transition of the Chair of the Murray-Darling Basin Authority from a full-time to a part-time role, and the creation of a new Chief Executive position. The determination also removes references to offices that have been dissolved, such as the Dairy Adjustment Authority, reflecting the evolving structure of public offices and their remuneration.
Scope and Application
The Remuneration Tribunal, as authorised by the Remuneration Tribunal Act 1973, has determined the remuneration and allowances for holders of public office, with the determination specified in Determination 2009/02. This determination applies to office holders within the Commonwealth of Australia and covers both part-time and full-time offices, adjusting remuneration based on changes in the nature of the office, such as transitioning from full-time to part-time. The determination also addresses specific allowances, such as travel allowances for certain executives, while ensuring that any retrospective application does not adversely affect the rights of individuals or impose liabilities on them, in accordance with the Legislative Instruments Act 2003. Certain offices and allowances are omitted or adjusted, such as those associated with the now defunct Dairy Adjustment Authority and the reclassified office of the Chair of the Murray-Darling Basin Authority.
Key Provisions
The Remuneration Tribunal has determined the remuneration and related matters for holders of public office under the Remuneration Tribunal Act 1973. This determination outlines specific remuneration for part-time and full-time offices, with particular focus on the roles within the Murray-Darling Basin Authority and the accommodation and travel allowances for the Chief Executive. The Tribunal arrived at these determinations through consultation, adhering to established practices.
The obligations of the parties governed by this Act include ensuring compliance with the specified remuneration and allowances. For instance, the Chair of the Murray-Darling Basin Authority is now remunerated as a part-time office holder, effective from 15 December 2008, as detailed in Clauses 1.2 to 1.3. Furthermore, the new office of Chief Executive, Mr Rob Freeman, is entitled to specific allowances, including accommodation and reunion travel, as long as his principal residence remains in Adelaide. Clauses 2.2 to 2.5 delineate these provisions. Any references to the now-defunct Dairy Adjustment Authority have been removed as per Clause 1.4.
Breach of the provisions outlined in this determination could potentially result in legal consequences. However, the Explanatory Statement specifies that any retrospective application of this determination does not adversely affect the rights of individuals (other than the Commonwealth or its authorities) nor does it impose any liability on them. This clarification is made in accordance with subsection 12(2) of the Legislative Instruments Act 2003. While the specific civil or criminal penalties for non-compliance are not detailed in the provided text, they would typically be governed by the relevant sections of the Remuneration Tribunal Act 1973 or other applicable legislation.
