Overview
The Remuneration Tribunal Determination 2008/21, issued under the Remuneration Tribunal Act 1973, addresses the remuneration and allowances for holders of public office in Australia. Enacted by the Remuneration Tribunal, this determination ensures that the remuneration for part-time and full-time office holders, as well as specified statutory officers, is regularly reviewed and adjusted as necessary to maintain fairness and alignment with current economic conditions. The policy objective of this determination is to provide clear and consistent guidelines for the remuneration of public office holders, ensuring that their compensation reflects their responsibilities and contributions to public service. The determination process involves consultation and inquiry, as outlined in the Act, to inform the Tribunal’s decisions and ensure they are both retrospective and prospective without adversely affecting the rights of individuals.
Scope and Application
The Remuneration and Allowances for Holders of Public Office Determination 2008/21 applies to various part-time and full-time office holders, as well as specified statutory officers, under the authority of the Remuneration Tribunal Act 1973. This legislation encompasses the review and determination of remuneration and related matters for these office holders, ensuring that their compensation aligns with established standards. The Remuneration Tribunal, empowered by the Act, has undertaken consultations and investigations to inform its decisions, as outlined in the determination. The scope of the Act is national, affecting public office holders across Australia. However, the determination explicitly states that any retrospective application does not adversely affect the rights of individuals, nor does it impose any liabilities on them, in accordance with subsection 12(2) of the Legislative Instruments Act 2003. The determination also includes amendments to existing schedules and tables, removing references to defunct bodies and correcting errors to ensure accurate application to current office holders.
Key Provisions
The Remuneration Tribunal has made determinations regarding the remuneration and allowances for holders of public office, as outlined in the Remuneration and Allowances for Holders of Public Office Determination 2008/21. Section 1 of the Determination states that it was made pursuant to the powers conferred by the Remuneration Tribunal Act 1973. Section 2 clarifies that the Tribunal's determination was informed through consultation in accordance with established practice. Importantly, Section 3 ensures that any retrospective application of this determination is compliant with subsection 12(2) of the Legislative Instruments Act 2003, safeguarding the rights of individuals and avoiding any disadvantage or liability to them.
In Part 1 of the Determination, Clause 1.1 references the Principal Determination (Number 7 of 2008 as amended) for part-time offices. Clause 1.2 corrects a reference to a body listed in Table A1A of Schedule A of the Principal Determination. Clause 1.3 removes references to offices associated with defunct bodies, namely the Research Quality Framework Reference Committee and Assessment Panels. Clause 1.4 concludes that, after reviewing remuneration levels, no further adjustments are necessary. Similarly, Part 2, Clause 2.1 references the Principal Determination (Number 8 of 2008 as amended) for full-time offices, with Clause 2.2 stating that, following a review, no adjustments to remuneration levels are required. Part 3, Clause 3.1 references the Principal Determination (Number 6 of 2008) for specified statutory officers, and Clause 3.2 states that no adjustments are necessary following the Tribunal's review.
The Remuneration Tribunal Act 1973 imposes specific obligations on the Tribunal when making determinations regarding remuneration. It must conduct its inquiries in accordance with established practices and ensure that any retrospective applications do not adversely affect the rights of individuals. The obligations also include making determinations based on thorough consultations and reviews of remuneration levels for office holders. Additionally, the Tribunal is required to comply with relevant legislative instruments, such as the Legislative Instruments Act 2003, to avoid any disadvantage or liability to individuals.
There are no explicit offences, penalties, or civil/criminal consequences detailed in the Determination itself. However, the Remuneration Tribunal Act 1973, under which this Determination is made, may impose penalties for breaches of its provisions. The exact penalties would depend on the specific nature of the breach and could potentially involve fines or other sanctions as determined by the relevant authorities. The Determination ensures that any retrospective applications comply with legal requirements, mitigating the risk of penalties or consequences for the Tribunal or affected individuals.
