Explanatory Statement: Determination 2008/16
Remuneration and Allowances for Holders of Public Office
1. The Remuneration Tribunal has inquired into and determined the remuneration and significantly related matters for office holders, as it is empowered to do by the Remuneration Tribunal Act 1973.
2. In making this determination the Tribunal has informed itself through consultation in accordance with established practice.
3. Any retrospective application of this determination is in accordance with subsection 12(2) of the Legislative Instruments Act 2003 as it does not affect the rights of a person (other than the Commonwealth or an authority of the Commonwealth) to that person’s disadvantage, nor does it impose any liability on such a person.
PART 1 – PART-TIME OFFICES
4. Clause 1.1 specifies the Principal Determination (Number 7 of 2008 as amended) for the purposes of Part 1 of the Determination.
5. Clause 1.2 deletes the entry for a body which is now defunct: the NHMRC Expert Advisory Group on Antimicrobial Resistance.
6. Clauses 1.3 to 1.4 provide for an increased level of remuneration for the offices of Senior Member and Member of the Veterans’ Review Board, with effect on and from 28 July 2008.
7. Clause 1.5 of Table 2A sets remuneration for the new office of Chair of the National Housing Supply Council.
PART 2 – FULL-TIME OFFICES
8. Clause 2.1 specifies the Principal Determination (Number 8 of 2008 as amended) for the purposes of Part 2 of the Determination.
9. Clauses 2.2 and 2.3 provide for an increased level of remuneration for the office of Senior Member of the Veterans’ Review Board, with effect on and from 28 July 2008.
10. Clause 2.4 deletes the entry for a full-time Member of the Veterans’ Review Board as there are no longer any full-time Members.
11. Clauses 2.5 and 2.6 increase the accommodation allowances determined for specified office holders, with the higher rates applying to those working in Sydney. The date of effect is on and from 1 July 2008.
12. Clauses 2.7 and 2.8 set remuneration for the new office of Infrastructure Coordinator, with effect on and from 1 July 2008.
13. Clauses 2.9 and 2.10 delete all references to accommodation allowances and reunion travel for Mr Patrick Walker, the member of the Australian Competition and Consumer Commission with responsibility for petrol price monitoring, with effect on and from the day after his arrangements in Melbourne come to an end.
PART 3 – MEMBERS OF PARLIAMENT
14. Clause 3.1 specifies the Principal Determination (Number 15 of 2008) for the purposes of Part 3 of the Determination.
15. Clause 3.2 amends the wording of Clause 1.3 of the Principal Determination to ensure that the only Senate Whips included in the list of Specified Office Holders are the principal Government Whip and the principal Opposition Whip.
16. Clause 3.3 removes reference to Whips in the definition of 'Office Holder' for the purposes of Part 2 of the Principal Determination.
17. Clause 3.4 specifies that Clauses 3.2 and 3.3 have effect from the commencement date of the Principal Determination.
