REMUNERATION TRIBUNAL
Explanatory Statement: Determination 2007/18
Remuneration and Allowances for Holders of Public Office and Members of Parliament
1. The Remuneration Tribunal has inquired into and determined the remuneration and significantly related matters for office holders, as it is empowered to do by the Remuneration Tribunal Act 1973.
2. In making this determination the Tribunal has informed itself through consultation in accordance with established practice.
3. Any retrospective application of this determination is in accordance with subsection 12(2) of the Legislative Instruments Act 2003 as it does not affect the rights of a person (other than the Commonwealth or an authority of the Commonwealth) to that person’s disadvantage, nor does it impose any liability on such a person.
PART 1 – PART-TIME OFFICES
4. Clause 1.1 specifies the Principal Determination (Number 10 of 2007 as amended) for the purposes of Part 1 of the Determination.
5. Clauses 1.2 and 1.3 provide for members of the ASC Pty Ltd Board to receive additional fees if they are also members of the Board’s Business Assurance and Security Committee.
6. Clauses 1.4 and 1.5 set remuneration for the new offices of Chair and Member of the Australian Families and Children Council, with effect on and from 1 July 2007.
7. Clauses 1.6 and 1.7 set remuneration for the new offices of Chair and Member of the Commission for International Agricultural Research (CIAR), with effect on and from 1 July 2007. They also remove the CIAR’s predecessor body, the Board of the Australian Centre for International Agricultural Research, from the Principal Determination with effect from the same day.
8. Clauses 1.8 and 1.9 set a new daily rather than annual fee for the office of National Convenor, Defence Families of Australia, with effect from 17 October 2007.
9. Clauses 1.10 and 1.11 set remuneration for the new offices of Chair and Member of the Export Wheat Commission (EWC), with effect on and from 1 October 2007. They also remove the EWC’s predecessor body, the Wheat Export Authority, from the Principal Determination with effect from the same day.
10. Clauses 1.12 and 1.13 set remuneration for the office of President of the National Competition Council, with effect on and from 18 December 2006.
11. Clause 1.14 deletes the reference to an obsolete body.
12. Clauses 1.15 and 1.16 set remuneration for the new offices of Chair and Member of the Regional Telecommunications Independent Review Committee, with effect on and from 14 August 2007.
PART 2 –JUDICIAL AND RELATED OFFICES
13. Clause 2.1 specifies the Principal Determination (Number 11 of 2007 as amended) for the purposes of Part 2 of the Determination.
14. Clauses 2.2 and 2.3 provide an increase in remuneration for both the full-time and part-time offices of Deputy President of the Administrative Appeals Tribunal with effect on and from 28 August 2007.
PART 3 –FULL-TIME OFFICES
15. Clause 3.1 specifies the Principal Determination (Number 13 of 2007 as amended) for the purposes of Part 3 of the Determination.
16. Clauses 3.2 and 3.3 set remuneration for the office of Chief Executive Officer of the Australian Pesticides and Veterinary Medicines Authority, with effect on and from 28 August 2007. This office was previously in the Principal Executive Office structure until it was removed recently as a result of changes to the Agricultural and Veterinary Chemicals (Administration) Act 1992.
17. Clauses 3.4 and 3.5 correct a typographical error made in a previous amending Determination (No 14 of 2007) regarding the office of Executive Director of Township Leasing, with effect on and from 1 July 2007.
18. Clauses 3.6 and 3.7 extend the application of the accommodation allowance determined for Dr Tony Webber, Director, Professional Services Review, to 13 February 2008.
19. Clauses 3.8 to 3.10 provide a personal loading for Ms Mary Urquhart, Deputy Principal Member, Refugee Review Tribunal, while she is also acting as a Senior Member of the Migration Review Tribunal, with effect from 3 September 2007.
20. Clause 3.11 and 3.12 adjust the base salary and total remuneration for the offices of Chair and Deputy Chair of the Superannuation Complaints Tribunal, with effect on and from 28 August 2007.
PART 4 – MEMBERS OF PARLIAMENT
21. Clause 4.1 specifies the Principal Determination (Number 18 of 2006 as amended) for the purposes of Part 4 of the Determination.
22. Clause 4.2 adds to the current clause in the Principal Determination which explains how Communications Allowance for parliamentarians is to be calculated. A new subclause provides a temporary mechanism for calculating the allowance for the member of a newly created electorate until the standard calculation can be applied.
